DRAFT <br /> REZONING AND STREET ABANDONMENT <br /> Rezoning <br /> Since the EIR was completed in 1989,City zoning was revised and transfer stations are no longer <br /> allowed under the site's M-1 (Light Industrial District)designation. As a consequence of the <br /> change in the zoning code the existing transfer station is considered a legal, non conforming use <br /> in the M-1 district. In addition,the proposed transfer station expansion includes the area west of <br /> Pershing Avenue, which is currently zoned CM(Commercial Manufacturing District). To bring <br /> the site into compliance with existing zoning,the portion of the site east of Pershing would be <br /> rezoned from M-1 to M-2(Heavy Industrial District)and the portion of the site west of Pershing <br /> would be rezoned from CM to M-2. <br /> Street abandonment and lot line merger <br /> The portion of Faye Street between Temple Street and Pershing Avenue and the portion of <br /> Pershing Avenue south of the Trinity Community Church would officially be abandoned by the <br /> City of Stockton prior to project implementation. In addition,two of the three lots that constitute <br /> the portion of the site east of Pershing,Assessor's parcel numbers 163-230-47 and 163-230-04, <br /> would be merged. The street abandonment and lot line merger will be completed prior to <br /> implementation of the project analyzed in this SEIR. <br /> E. REQUIRED PROJECT APPROVALS AND PERMITS <br /> The project would require the following permits and approvals: <br /> • Conditional Use Permit(# ) (Planning Commission approval required) <br /> • Application to Rezone (#®) (City Council and Planning Commission approval required); <br /> • Solid Waste Facilities Permit(#_) from the California Integrated Waste Management <br /> Board(which has Local Enforcement Agency(LEA) authority in Stockton) <br /> • Permit to operate refuse vehicles(# )from the San Joaquin Department of Environmental <br /> Health <br /> • Authority to Construct and Permit to Operate from the San Joaquin Valley Unified Air <br /> Pollution Control District green waste tub grinder(#_) and other non-electric equipment <br /> • Stormwater Discharge General Permit(NPDES)from the California Water Resources Board <br /> • Building permit, including approval of fire sprinkler system plan <br /> • Permit to store and use flammable and combustible liquids from the City of Stockton Fire <br /> Department <br /> • Lot line merger(approval from City of Stockton Department of Public Works) <br /> Stockton Scavenger Transfer Station Expansion 8 ESA/990190 <br /> Preliminary—Subject to Revision(October 18,1999) <br />
