The enclosed Memorandum contains staff comments on <br />the Construction Quality Assurance report. I concur with the staff conclusion <br />that the required in situ permeability testing was not completed. <br />The flexible membrane liner and leachate collection system could be removed <br />and in situ testing could still be done to verify construction to the required <br />permeability. However, winter rains would likely make it impossible to <br />complete the testing this winter, we understand that Musco needs to use the <br />pond immediately. Moreover, staff is of the opinion that the clay liner is <br />probably constructed to meet the permeability requirement. Therefore, I <br />approve the construction of Pond B at Musco Olive Products, Tracy. <br />This approval should not be construed as an indication that we will accept <br />similar CQA in the future.
