WASTE DISCHARGE REQUIREMENTS -2- <br /> CITY OF MANTECA AND CITY OF LATHROP <br /> WASTEWATER QUALITY CONTROL FACILITY <br /> SAN JOAQUIN COUNTY <br /> 8. The beneficial uses of the San Joaquin River are municipal , industrial , and <br /> agricultural supply; recreation; aesthetic enjoyment; navigation; ground water <br /> recharge; fresh water replenishment; hydroelectric power generation; and <br /> preservation and enhancement of fish, wildlife and other aquatic resources. <br /> 9. The beneficial uses of the ground water are municipal , industrial , and domestic <br /> supply. <br /> 10. The State Water Resources Control Board adopted the "California Inland Surface <br /> Waters Plan, and California Enclosed Bays and Estuaries Plan" (Plans) on 11 April <br /> 1991. The Plans include water quality objectives and other requirements. The <br /> Board intends to revise this permit pursuant to the Plans. <br /> 11 . The State Water Resources Control Board (SWRCB) Water Quality Control Plan for <br /> Control of Temperatures in Coastal and Interstate Waters and Enclosed Bays and <br /> Estuaries of California (the Thermal Plan) is applicable to this discharge. <br /> Effluent Limitation C.7 and Receiving Water Limitations E.9 and E. 10 are included <br /> to achieve compliance with the Thermal Plan. <br /> 12. The Board has considered antidegredation pursuant to 40 CFR 131 . 12 and SWRCB <br /> Resolution 68-16 and finds that the permitted discharge is consistent with those <br /> provisions. This order provides for an increase in the volume and mass of <br /> pollutants discharged. The impact on water quality will either be localized or <br /> not significant. There is no evidence to indicate that the increase will cause <br /> significant impacts on aquatic life beneficial uses, the primary ones affected <br /> by the pollutants discharged (BOD, suspended solids, chlorine residual , <br /> temperature, and metals) . The increase in the discharge allows wastewater <br /> utility service necessary to accommodate economic expansion in the Manteca area. <br /> 13. The SWRCB, on 16 May 1974, adopted Resolution No. 74-43 titled "Water Quality <br /> Control Policy for Bays and Estuaries of California". As this discharge is to <br /> the San Joaquin River, an estuarine water of the state, this Policy is <br /> applicable. <br /> 14. Effluent limitations, and toxic and pretreatment effluent standards established <br /> pursuant to Sections 208(b) , 301, 302, 304, and 307 of the Clean Water Act and <br /> amendments thereto are applicable to the discharge. <br /> 15. The Discharger is required to establish a Pretreatment Program to enforce the <br /> requirements promulgated under Sections 307(b) , (c) , (d) , and 402(b) of the Clean <br /> Water Act. Provisions contained in Order No. 85-068 established a time schedule <br /> for compliance with this requirement. The Discharger is in violation of those <br /> Provisions for not having developed and implemented a Pretreatment Program. This <br /> permit contains a time schedule for development, submittal , and implementation <br /> of a Pretreatment Program. <br /> 16. The action to renew an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section 21000, et <br /> seq.) , in accordance with Section 13389 of the California Water Code. <br />
