Rainwater Car Wash Page 3 <br /> 420 West Yosemite Avenue October 24, 2011 <br /> Manteca, California 95337 <br /> By letter dated 26 September 2007, the EHD memorialized a meeting between AGE and <br /> EHD personnel on 20 April 2007 where remediation activities at this site were discussed. <br /> Included in the letter were an approval by the EHD to reduce the frequency of sampling <br /> monitoring wells; a directive to determine the impact tetrachloroethene (PCE) and <br /> trichloroethene (TCE) peaks, detected in the chromatograms of total petroleum <br /> hydrocarbons as gasoline (TPH-g), had on the concentrations reported for TPH-g; and <br /> directives by the EHD to submit a work plan to install additional groundwater extraction <br /> wells and a vapor intrusion evaluation to the EHD by 26 October 2007. <br /> By letter dated 16 January 2009, the EHD approved Addendum to Interim Remediation <br /> Work Plan —April 2008, dated 21 April 2008, submitted by AGE for the installation of two <br /> extraction wells along with the directives that the two proposed groundwater extraction <br /> wells be installed by 27 March 2009 and a site conceptual model (SCM) be submitted by <br /> 27 March 2009. The EHD also approved a reduction in the frequency of groundwater <br /> sampling. On 14-15 January 2010, extraction wells EW-2 and EW-3 were installed and <br /> the SCM, dated 01 June 2010, was submitted to the EHD. <br /> On 06 October 2010 AGE notified the EHD that effective 24 September 2010 AGE had <br /> temporarily suspended all monitoring and remediation activities since Mr. Elder had <br /> notified AGE that he was not able to provide payment for past-due invoices even though <br /> Mr. Elder had received reimbursement from the Fund. Mr. Elder has failed to respond to <br /> the EHD directives listed in the bullets of this letter when directed to do so by letter dated <br /> 01 December 2010. <br /> On 28 March 2011, another meeting was held attended by Mr. Elder, AGE and the EHD. <br /> At that time, the EHD gave Mr. Elder an additional 75 days to submit a proposal to restart <br /> the pump-and-treat remediation system. To date, Mr. Elder has not responded to any of <br /> the EHD directives. <br /> A chronology is included as an attachment to this letter along with a disc containing work <br /> plans and reports dated between 1998 and 2005.
