In regard to the (TBD) To Be Determined bins, they will be eliminated, and the
associates will make an immediate waste determination utilizing the WERCS scan
system or contacting the corporate office. If the bins do become full prior to the next pick
up, management is advised to create a new bin until the next pick up from the
hazardous waste hauler.
Violation #109 - Failed to send generator manifest copies to DTSC within 30 days
This violation has been corrected. Violation corrected on 10-31-19.
All manifests are accounted for. Our hazardous waste hauler sends all manifests to
DTSC on our behalf. I have included a letter from our waste hauler, US Ecology stating
that they send our manifests on our behalf.
(v#109 Smart and Final DTSC Letter)
Violation #110 - Failed to keep signed copy of manifests from the designated
facility for three years.
This violation has been corrected. Violation corrected on 11-01-19.
All manifests have been updated and are present in the green hazardous waste binder
in the store. Copies of the manifests are included with the response.
(v#110 03-05-19 MF_011386221 FLE, v#110 03-05-19 MF_011386222FLE, v#110 02-13-19 MF
012962758FLE, v#110 01-31-17 MF_008548533FLE, v#110 09-25-19 MF 020590260JJK,
v#110 07-25-19 MF 020202871JJKI v#110 04-04-19 MF_012962869FLE, v#110 11-13-18
MF_011392825FLE, v#110 10-02-18 MF_012120094FLE, v#110 09-13-18 MF_011392693FLE,
v#110 04-04-18 MF_010868402FLE, v#110 10-23-17 MF_010790389FLE, v#110 07-05-17
MF_008553743FLE)
Violation #111 - Failed to comply with uniform hazardous waste manifest
exception requirements.
This violation has been corrected. Violation corrected on 10-31-19.
All manifests are all accounted for, therefore no need to generate a hazardous waste
manifest exception report. Copies of all manifests are included in the response.
Violation #401 - Failed to store hazardous waste in a container that is in good
condition
This violation has been corrected. Violation corrected on 10-31-19.
After speaking with the Senior Assistant Manager, Thomas Champion, regarding the
condition of the bins during the inspection, he advised me that he had recently ordered
new bins and they were in the store at the time of the inspection, however he had not
yet had a chance to replace them. The bins were replaced immediately after the
inspection. I have included pictures of the replaced bins.
(v#401 Haz Mat Rack)
Violation #403 - Failed to keep hazardous waste containers closed except when
adding or removing hazardous waste
This violation has been corrected. Violation corrected on 10-31-19.
The bins have been replaced, and management has been instructed to create new bins
in the event the current bins become full. In addition, management is instructed to call
for an expedited pick up from the hauler to avoid overfilling bins or excessive waste on
site.
(v#403 Haz Mat Rack)
