Disposal records for the used oil filters for the last three years were not <br />found on site. Per California Health & Safety Code (HSC) 25163, a valid hazardous waste transporter license is <br />required to transport hazardous waste. Per Title 22 California Code of Regulations (CCR) 66266.130, oil filters that <br />are not completely drained need to be managed as hazardous waste. If the oil filters are completely drained, they <br />can be disposed of via recycling. A bill of lading needs to be left with the facility for drained oil filters. Per 22 CCR <br />66266.130 (c)(5), a bill of lading needs to indicate: the generator and transporter, the receiving company names, <br />addresses and telephone numbers, the quantity and size of the used oil filter containers transferred, and the date of <br />transfer. If the oil filters are being taken as recycling, immediately start to store the bill of ladings when the waste <br />leaves the site. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by December 2, 2018. <br />Starting September 1, 2018, all in -office CERS help will be provided at EHD hourly rate ($152). To schedule an <br />appointment, please call (209) 468-3420. <br />The following violations were corrected on site: <br />A drain pan attached to a blue 55 gallon metal drum was observed full. An uncrushed/ undrained oil filter was <br />sitting in the liquid. During the inspection, the oil filter was placed into an oily debris container and the oil in the <br />overfilled drain pan was transferred to another hazardous waste drum. Facilities shall be maintained and <br />operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface <br />water which could threaten human health or the environment. Immediately start maintaining the facility to <br />prevent releases. <br />In the used oil area, one blue 55 gallon drum containing used oil (full) was attached to an open drip pan that was <br />overfilled. <br />In the used coolant area, one blue 55 gallon poly drum containing used coolant (3/4 full) was observed with an <br />open bung hole. <br />All hazardous waste containers shall be closed at all times except when adding or removing waste. Both of the <br />containers were fixed and closed during the inspection. Immediately ensure all hazardous waste containers are <br />closed when not adding or removing waste. <br />In the used coolant area, one blue 55 gallon poly drum was observed without an empty label. Containers larger <br />than five gallons that previously held a hazardous material shall be marked with the date they were emptied and <br />managed within one year of being emptied.
