5.0 USER PROVIDED INFORMATION AND INTERVIEWS <br /> In order to qualify for one of the Landowner Liability Protections (LLPs) offered by the Small Business <br /> Liability Relief and Brownfields Revitalization Act of 2001 (the Brownfields Amendments), the User must <br /> conduct the following inquiries required by 40 CFR 312.25, 312.28, 312.29, 312.30, and 312.31. The User <br /> should provide the following information to the environmental professional. Failure to provide this <br /> information could result in a determination that all appropriate inquiries is not complete. The User is <br /> asked to provide information or knowledge of the following: <br /> • Review Title and Judicial Records for Environmental Liens and AULs <br /> • Specialized Knowledge or Experience of the User <br /> • Actual Knowledge of the User <br /> • Reason for Significantly Lower Purchase Price <br /> • Commonly Known or Reasonably Ascertainable information <br /> • Degree of Obviousness <br /> • Reason for Preparation of this Phase I ESA <br /> Fulfillment of these user responsibilities is key to qualification for the identified defenses to CERCLA <br /> liability.
