Failed to keep signed copy for 3 years. 123. Failed to determine the status of hazardous waste when manifest copy not received. 124. Failed to file an exception report. Generator copy of manifest#010835939JJK, 11/4/2013 was seen without the TSDF copy. Hazardous waste generators must maintain copies of TSDF-signed manifests for 3 years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter,the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If within 45 days,from the date that the hazardous waste was accepted by the initial transporter,the generator did not receive a copy of the manifest with the handwritten signature of the owner/operator of the designated facility,the generator shall submit to DTSC a legible copy of the manifest,with some indication that the generator has not received confirmation of delivery. Within 30 days, September 6,2014,provide this office with a copy of the TSDF copy or the exception report submitted to DTSC. 204. Disposed or caused disposal of HW at an unauthorized point. -A broken CFL was seen in a trash hopper outside of module 3 -Hazardous waste manifests for retail hazardous waste were not available prior to March 2014. Between March 2014 and July 2014 approximately 8.8625T of retail hazardous waste was disposed of as hazardous waste for this facility. When asked about disposal records and information regarding absence of disposal records prior to March 2014,Brad Moniz and Jesus Gomez, Safety Manager said they did not know. When Joe Allen Jr.was asked for the same information he said they did not have disposal records for retail hazardous waste prior to March 2014. When asked what would happen to broken,leaking items such as hand soap or body wash he said those items probably would have ended up in the trash. The disposal of any hazardous waste,or the causing of disposal,is prohibited when the disposal is at a facility which is not permitted for hzardous waste disposal. Immediately cease disposal of hazardous waste at unauthorized points. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
