The following is an itemized list of hazardous waste violations that have not been <br /> addressed for GILL EXPRESS INC as of September21, 2018. <br /> Open violations from August 17, 2018 inspection <br /> Violation#117-Failed to complete training on hazardous waste management and emergency response <br /> procedures. <br /> At the time of the inspection no training records were available for review. Personnel who handle hazardous waste <br /> shall be trained within six months of assignment and take part in an annual review of the initial training received. At <br /> a minimum, the training program shall be designed to ensure that facility personnel are able to respond effectively to <br /> emergencies by familiarizing them with emergency procedures, emergency equipment, and emergency systems, <br /> including where applicable: <br /> 1. procedures for using, inspecting, repairing, and replacing facility emergency and monitoring equipment; <br /> 2. key parameters for automatic waste feed cut-off systems; <br /> 3. communications or alarm systems; <br /> 4. response to fires or explosions; <br /> 5. response to ground-water contamination incidents; and <br /> 6. shutdown of operations. <br /> The owner or operator shall maintain the following documents and records at the facility: <br /> 1. the job title for each position at the facility related to hazardous waste management, and the name of each <br /> employee filling each job; <br /> 2. written job description for each position listed above; <br /> 3. written description of the type and amount of both introductory and continuing training that will be given to <br /> each person filing positions listed above; <br /> 4. records that document that the training has been given to and completed by facility personnel. <br /> Training records on current employees shall be kept until closure of the facility. Training records on former <br /> employees shall be kept for at least three years from the date the employee last worked at the facility. Immediately <br /> provide employees with initial or refresher hazardous waste training. Submit a copy of the roster and the syllabus to <br /> the EHD. <br /> Violation #123 -Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on May 2, 2016 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted by June 2, 2016. This <br /> information has not been received resulting in a non-compliant status for this facility. An operator that receives an <br /> inspection report shall have 30 days to submit a written response that includes a statement documenting corrective <br /> actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting <br /> corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. These are the <br /> violations that remain open from the May 2, 2016 inspection: <br /> -Failed to maintain all communication or alarm systems, spill control, or decontamination equipment <br /> -Failed to prepare and implement a contingency plan <br /> -Failed to properly manage used oil and fuel filters <br /> -Failed to maintain complete personnel training records <br /> -Failed to comply with new hazardous waste tank system assessment requirements <br /> -Failed to conduct daily inspections of hazardous waste tank system and maintain records on site <br /> -Failed to report program data electronically <br /> -Failed to completely label containers or portable tanks of hazardous waste <br /> -Failed to keep signed copy of manifests from the designated facility for three years <br /> -Failed to complete training on hazardous waste management and emergency response procedures <br /> Violation #125 -Failed to report program data electronically. <br /> A submission to the California Electronic Reporting System (CERS) for the hazardous waste program has not been <br /> made. Beginning January 1, 2013, all businesses are required to submit all new(or any changes to existing) <br /> hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous <br /> waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br /> fields. <br /> Page 2 of 7 <br />
