Box 1810 <br /> Stockton, CA 95201 <br /> WATER CODE SECTION 13267 ORDER FOR TECHNICAL REPORTS FOR THE CORRAL <br /> HOLLOW LANDFILL, SAN JOAQUIN COUNTY (CASE NO. 1896) <br /> In a letter dated 24 June 2002, Central Valley Regional Water Board staff(staff) informed the San <br /> Joaquin County Department of Public Works that they would be in violation of Waste Discharge <br /> Requirements (ArDRs) Order No. 5-01-176 if they failed to provide the Annual Report of Financial <br /> Assurance by I August 2002. Order 5-01-176 lists Tasks and Compliance dates, which state that the <br /> Annual Financial Reports are due to the Executive Officer by 30 April of each year. As of the date of <br /> this letter we have not received the reports. <br /> WDRs Order No. 5-01-176,Provision G., states: <br /> 10. The Discharger shall demonstrate financial responsibility for initiating and completing corrective action,and <br /> shall submit a report for financial assurances annually to the Executive Officer review and approval. The assurances <br /> of financial responsibility shall name the Regional Board as beneficiary and shall provide that funds for corrective <br /> action shall be available to the Regional Board upon the issuance of any order under California Water Code, <br /> Division 7,Chapter 5. The Discharger shall adjust the cost annually to account for inflation and any changes in <br /> facility design,construction,or operation. <br /> 11. The Discharger shall demonstrate financial responsibility for closure and post-closure maintenance,and shall <br /> submit a report of financial assurances annually for Executive Officer review and approval. The assurances of <br /> financial responsibility shall provide that funds for closure and post-closure maintenance shall be available to the <br /> Regional Board upon the issuance of any order under California Water Code,Division 7,Chapter 5. The Discharger <br /> shall adjust the cost annually to account for inflation and any changes in facility design,construction,or operation. <br /> California Water Code(CWC) Section 13267 states, in part: <br /> "(b)(1) In conducting an investigation..., the regional board may require any person who <br /> has discharged, discharges, or is suspected of discharging, or who proposes to discharge <br /> waste within its region...shallfurnish, under penalty ofperjury, technical or monitoring <br /> reports which the regional board requires. The burden, including costs, of these reports <br /> shall bear a reasonable relationship to the need for the report and the benefits to be obtained <br /> from the reports.
