The parcel is not subject to a Williamson Act contract. Referrals has been <br /> sent to the San Joaquin Farm Bureau for review. <br /> 3. Plant/Animal Life <br /> 3, a. & b. The Natural Diversity Database identifies Agelaius. tricolor (tricolored blackbird), Buteo <br /> swainsoni (Swainson's hawk), Aster lentus (Suisun Marsh aster), Cirsium crassicaule (slough <br /> thistle), Xanthocephalus xanthocephalus (yellow-headed blackbird), Aster lentus (Suisun marsh <br /> aster), and Athene cunicularia (burrowing owl) as rare, endangered, or threatened species or <br /> habitat located on or near the site. Referrals have been sent to the San Joaquin Council of <br /> Governments (SJCOG) for review. If SJCOG determines that the applicant can participate in the <br /> San Joaquin Multi-Species Habitat Conservation and Open Space Plan (SJMSCP), and if the <br /> applicant chooses to participate, then the proposed project is consistent with the SJMSCP, as <br /> amended, as reflected in the conditions of project approval for this proposal. Pursuant to the Final <br /> EIR-AE/S for San Joaquin County Multi-Species Habitat Conservation and Open Space Plan <br /> (SJMSCP), dated November 15, 2000, and certified by SJCOG on December 7, 2000, <br /> implementation of the SJMSCP is expected to reduce impacts to biological resources resulting <br /> from the proposed project to a level of less-than-significant. If the applicant chooses not to <br /> participate, then the applicant will be required to participate in a similar mechanism that provides <br /> the same level of mitigation. <br /> 4.Air]Cllmate <br /> 4.a. This project is an expansion of an existing composting facility that processes urban green <br /> waste, wood, and agricultural residue to include the composting of commercial food and <br /> digestate. The project includes an increase in the processed tonnage from 156,000 tons per year <br /> to 182,000 tons per year and an increase in the project area from 20 acres to 40 acres. The San <br /> Joaquin Valley Unified Air Pollution Control District (SJVAPCD) sent a response letter dated <br /> October 6, 2016 that states that project emissions should be identified and quantified, and that a <br /> Health Risk Assessment (HRA) should be performed if the project is located near <br /> residential/sensitive receptors and Toxic Air Contaminants (TACs) are a concern. The surrounding <br /> parcels are primarily agricultural with scattered residences and the nearest residence is located 30 <br /> feet from the eastern property line of the subject parcel. In addition, the project is subject to District <br /> Rule 2010 (Permits Required) and Rule 2201 (New and Modified Stationary Source Review), and <br /> may be subject to other District rules. The applicant submitted a Health Risk Assessment dated <br /> October 28, 2016 to the SJVAPCD. Based on information provided by the applicant, the project <br /> will not result in a significant increase in risk to any surrounding receptors. This analysis was <br /> based on the 60% mitigation measure for the windrow composting operation and with the <br /> understanding the grinding and screening will operate in the center of the new facility footprint, as <br /> stated in the modeling runs. The Environmental Health Department (EHD) is also requiring a <br /> revised Odor Impact Management Plan (OIMP) to account for changes in operation. With the <br /> rules and regulations of the SJVAPCD and the END, the impact to air quality and the impact from <br /> odors will be less than significant. <br /> 5. Noise <br /> 5. a. This project is for the expansion of an existing composting facility which falls under the Major <br /> Impact Services use type. Pursuant to Development Title Table 9-1025.9, this use type is not a noise <br /> sensitive land use. However, the surrounding parcels are primarily agricultural with scattered <br /> residences and pursuant to Development Title Table 9-1025.9 Part 1, a Title Section 9- <br /> 1025.9(a)(1) residential uses are noise sensitive land uses.
