During the 26 May meeting, Central Valley Water Board staff indicated that <br />Title 27 and Title 23 requirements would not be applicable to the project if the stabilized waste <br />was shown to be inert. Also, if inert, staff indicated that WDRs would not be necessary. <br />If the stabilized waste is determined to be designated or hazardous as defined in Title 27 or <br />Title 23, requirements that the RAP must demonstrate compliance with include: adequate <br />waste characterization analyses, expected volumes of contaminated soil, and expected <br />concentrations of contaminants; pilot study results showing effectiveness of proposed waste <br />stabilization methods; waste leachability studies and development of suitable waste <br />acceptance criteria (both treated and untreated waste); at least five feet of separation between <br />highest groundwater table elevation and the waste; proximity to the 100-year flood plain; <br />monitoring of groundwater, surface water, and the unsaturated zone; design requirements for <br />the liner system; design of the leachate collection system or demonstration that the system is <br />not necessary; seismic design requirements; compliance with storm water construction <br />regulations; programs for water quality monitoring and response; establishment of financial <br />assurances for post-closure maintenance and corrective action; submittal of a Report of Waste <br />Discharge (ROWD); Central Valley Water Board acceptance of the ROWD and issuance of <br />Waste Discharge Requirements (WDRs); and annual WDR fees of approximately $38,000 to <br />$50,000 per year. <br />Central Valley Water Board staff looks forward to assisting the Port of Stockton with this <br />project. The Maritime Highway Corridor Project clearly has positive environmental benefits for <br />Northern California.
