Box 1810 <br /> Stockton, CA 95201 <br /> HARNEY LANE LANDFILL EXPANSION; SAN JOAQUIN COUNTY <br /> It has recently come to our attention that the subject site has reached design <br /> capacity, but that the county plans to extend this capacity by raising the final <br /> grade elevations. In reviewing your present Waste Discharge Requirements, Order <br /> No. 78-147, we find that you are in violation of Provisions B.2 and B.3, which <br /> read: <br /> 9.2. The discharger shall file with this Board a report of any material change <br /> or proposed change in the character, location, or quantity of this waste <br /> discharge. For the purpose of these requirements, this includes any pro- <br /> posed change in the boundaries, contours, or ownership of the disposal <br /> area. <br /> 9.3. The discharger shall file a written report within 90 days after the total <br /> quantity of wastes discharged at this site equals 75 percent of the <br /> reported capacity of the site. The report shall contain a schedule for <br /> studies, design, and other steps needed to provide additional capacity or <br /> the total quantity discharged shall be limited to the reported capacity." <br /> Additionally, revised "Discharges of Waste to Land" regulations, contained in <br /> Subchapter 15 of Title 23, Chapter 3 of the California Administrative Code, became <br /> effective on 27 November 1984. These regulations pertain to disposal operations <br /> where wastes are discharged. to landfills. <br /> Subsection 2590(b) of Subchapter 15 states, in part: <br /> "1) Dischargers who own or operate existing waste management units for which <br /> waste discharge requirements were issued before the effective date of this <br /> subchapter shall , within six months of the effective date of this section, <br /> submit a technical report to the regional board describing the measures <br /> necessary to bring their monitoring programs into compliance with Article 5 <br /> of this subchapter, including a schedule for achieving compliance. The <br /> regional board shall modify waste discharge requirements accordingly." <br />
