Access Agreement - Authorization Statement <br />Permission is granted to Advanced GeoEnvrionmental, Inc (AGE) acting on behalf <br />of Mr. Paul Shidu, property owner of 3032 East Waterloo Road, Stockton, California, to install <br />a permanent monitoring well and sample said well on the property at 1912 North Sutro <br />Avenue, Stockton, California, at a location agreeable to Ms. Laura Bresciani, the PROPERTY <br />OWNER herewithin. <br />The installation of a ground water monitoring well and sampling of the well will be <br />conducted in accordance with San Joaquin County regulations in order to collected ground <br />water samples as part of the investigation of the gasoline contamination at the former Arco <br />gasoline station at 3032 East Waterloo Road, Stockton, California. <br />AGE will agree to PROPERTY OWNER designated hours of access, make reasonable <br />efforts to avoid or minimize interference with or disrupt any activities at the property or by <br />the PROPERTY OWNER Further AGE will hold general commercial liability insurance to <br />cover $1,000,000 for damage, personal damage and death; auto; and workman compensation <br />in accordance with the laws of the State of California. <br />INDEMNITY <br />The PROPERTY OWNER has no assumed liabilities for any injury or damages that may <br />occur during these activities on the property. AGE and the property owner from 3032 East <br />Waterloo Road, Stockton, California, agree to indemnify, defend and hold harmless the <br />PROPERTY OWNER against any claims, suits or demands, including attorney's fees and <br />court costs, arising out of AGE's performance of investigation work at the PROPERTY <br />OWNER's property brought by any third party, person, entity or government body. <br />Also, AGE and the property owner from 3032 East Waterloo Road agree to indemnify, defend <br />and hold harmless the PROPERTY OWNER against any claims, suits or demands, including <br />attorney's fees and court costs, arising out of, or in any connected to AGE's entry on the <br />PROPERTY OWNER' s property. <br />Dated: ,2001 <br />PROPERTY OWNER.
