stoppages. Access problems within the main trunk sewer system shall require <br />visual physical inspection of those areas at least once every ninety (90) day <br />period. Such inspections shall be identified in the monthly Sewer Report. <br />3.11 Emergency Response. 7-H shall respond to emergency calls within one <br />hour (60 minutes) from the time of the notifications or when reasonably able to do <br />so, which ever is earlier. 7-H shall respond to emergency calls concerning <br />FACILITY 24 hours per day, seven (7) days per week, including holidays. 7-H <br />shall maintain, on site any equipment required for lateral sewer emergency <br />responses. <br />3.12 Fines. While this AGREEMENT is in force, and so long as FACILITY meets <br />applicable regulatory permit or customary design criteria for wastewater <br />treatment, and as long as CITY has not rejected or failed to act upon 7-H's <br />operational and maintenance recommendations which would have corrected or <br />prevented any violation of regulations resulting in actions, 7-H shall pay any and <br />all fines or penalties levied against CITY or 7-H (or its agents) as a result of <br />actions taken by the California Water Quality Control Board or USEPA arising <br />from 7-H's operation and maintenance of FACILITY. 7-H shall have the right to <br />contest any all fines. 7-H shall be limited to the comparative fault of 7-H or its <br />agents for such fines. <br />3.13 Insurance. 7-H shall maintain during the life of AGREEMENT the following <br />insurance. <br />Public Liability and Property Damage <br />$2,000,000 (combined single limit) <br />General Liability <br />$2,000,000 (combined single limit) <br />Automotive Liability <br />$2,000,000 (combined single limit) <br />Workers Compensation <br />Per state and federal law, 7-H waives the right of subrogation. <br />Such policies shall name the CITY, its officers, agents, employees, elected and <br />appointed boards, as additional insured according to its insurable interest under <br />these policies during the term of AGREEMENT. Evidence of said insurance and <br />endorsements shall be supplied to the CITY. 7-H agrees to provide CITY with <br />proof of such insurance and will require insurer to give CITY thirty (30) days <br />written notice of cancellation or material change in said policies. Subcontractors <br />shall also be included as insured by 7-H or, 7-H shall be required to provide CITY <br />7-H Technical Services Group Contract for Operation and Maintenance Services Page 7 of 12
