SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />deduction shall be paid to or removed from the contract at the actual necessary cost as <br />determined by the sum of the following items: <br />.1 Labor, including wages and benefits at rates established pursuant to Labor Code <br />section 1720 et seq., premiums for workers compensation insurance, Social <br />Security and Medicare taxes, and other taxes pertaining to labor. Labor costs <br />shall be recoverable for workers actually performing the Work, and first line <br />supervision including working foreman or lead craft works, but excluding <br />superintendents. <br />.2 Material, including sales or use taxes and other taxes pertaining to materials. <br />.3 Plant and equipment rental, to be agreed upon in writing. No charge for the cost <br />of repairs to plant or equipment will be allowed. No amount will be paid for small <br />tools, whether rented from Contractor or others. For equipment owned by the <br />Contractor, equipment rental rates shall not exceed the labor surcharge and <br />equipment rental rates as set forth by California Department of Transportation <br />(Cal Trans). Please refer to the CAL Trans website: http://www.dot.ca.gov. <br />.4 Actual cost of project superintendent and/or project manager, but added only if <br />the Contract Time is extended by virtue of the Modification and the actual cost <br />incurred by Contractor is increased. In the absence of a compensable delay, any <br />additional cost for project superintendent or project manager shall be considered <br />paid for as part of the overhead and profit payment. <br />.5 Subcontractor costs computed according to these same standards. <br />6 Overhead and profit computed as provided in §7.2.3 above. <br />§7.2.8 Oral Modifications: Oral statements of any person shall not in any manner or degree, <br />modify or otherwise affect the terms of the Contract. <br />§7.2.9 Verbal direction: In cases where the work may be adversely affected in time and or cost <br />the Owner or Architect may provide verbal direction pertaining to changes in the work <br />and work on such direction shall proceed as if written modification were provided until <br />such time as written Construction Change Document (CCD) or change order is provided. <br />§7.2.10 Record Keeping: In the event that the pricing method selected is the "cost plus" (time <br />and materials) method described above, Contractor shall keep and present daily to the <br />Owner, in such Manner as the Owner prescribes. Prior to beginning additional work and <br />at the conclusion of such work each day, or at each interval of the work, Contractor shall <br />present to the Project Inspector for verification the number of persons, the equipment <br />and the materials to be utilized in performing the work. Inspector shall sign <br />documentation of verification and return the signed documentation to the Contractor. <br />Signed documentation shall be presented to the Owner when work is complete and prior <br />to inclusion, of work performed on a time and materials bases, in a written modification <br />to the contract. <br />ip <br />
