depend on obtaining service from such utilities, then the utility lines shall be sized to serve <br /> these future developments. <br /> 3. When public utilities are to be located outside public rights-of-way but within the project <br /> boundary, the Developer shall provide public utility easements for these utilities. The <br /> easements shall be shown on all the Improvement Plans. All utilities within private right of way <br /> are owned and maintained privately. <br /> 4. Water service-to the common areas, if applicable, shall not begin without notifying MHCSD of <br /> the intent to start irrigation. The billing process must be set up before water is turned on. <br /> Backflow prevention systems and applicable water meter facilities at the point of connection to <br /> the public water system as required by the MHCSD Standards shall also be installed. <br /> 5. Prior to issuance of the first building permit design and construct storm drainage system in <br /> accordance with the requirements of the MHCSD Storm Water Master Plan and Storm Water <br /> Master Plan Amendments and Addendums. <br /> 6. Storm drain inlet structure for the storm drain line off of Nasergholi Avenue across parcel A <br /> shall be adjusted to capture potential runoff from abandoned historic irrigation channel to the <br /> north and shall be located on MHCSD property. Timing: Prior to civil improvement plan <br /> approval. <br /> g. Landscaping and Architecture: <br /> 1. All in-tract landscaping and utility R/W areas and all other landscape and open space areas <br /> that were not in the original Master Plan, the MHCSD Parks, Recreation and Leisure Plan, the <br /> TIS or CIF and determined by MHCSD,will require annexation to the existing SPIII Landscape <br /> and Lighting District. These areas will require annexation into the existing SPIII Landscape and <br /> Lighting District to provide funding for maintenance of, and if necessary, replacement at the <br /> end of useful life of improvement including but not limited to landscaping, pathways, walls, <br /> lighting, and all improvements serving or for the special benefit of this subdivision. Tract 4040 <br /> shall be incorporated into the existing Lighting and Landscape Maintenance District for SPIII. <br /> Timing: The annexation into the existing Landscape and Lighting District shall be completed <br /> prior to recordation of the final map. <br /> 2. The applicant shall comply with the landscaping and architectural theme used within the <br /> existing Neighborhood A. Design shall be consistent with all Community Approvals including <br /> applicable provisions of the MHCSD Design manual, applicable Special Purpose Plan, and <br /> Neighborhood A In-Tract Landscape Guidelines. Timing: Improvement Plans approved by SJ <br /> County CDD and MHCSD prior to recordation of final map. <br /> 3. The applicate shall update, as necessary the Neighborhood A In-Tract landscape Guidelines <br /> to incorporate Tract 4040. Timing: prior to issuance of the first building permit. <br /> 4. The open space corridor linear park shall comply with the 2021 MHCSD Parks, Recreation and <br /> Leisure Plan and the approved concept plans for the A3 and B2/B3 sections of the open space <br /> corridor linear park. Timing: Prior to MHCSD approving the plans the developer must submit to <br /> MHCSD written approval from the gas utilities, PG&E and Crimson, of the improvement plans. <br /> The plans shall be reviewed and approved by MHCSD prior to issuance of the first building <br /> permit. <br /> 5. All landscaped areas that will be dedicated to MHCSD and shown on sheet TM-5 of the <br /> Preliminary Pedestrian and Open Space Plan, dated August 16, 2022, and also shown on <br /> sheets TM-9 through TM-10 of the Schematic Landscape Design Overall Landscape Plan, <br /> dated August 17, 2022 of the Tract 4040 Neighborhood Tentative Map Package shall be <br /> designed and improvement plans approved by MHCSD prior to the issuance of 50% of the <br /> PA-2100120—Conditions of Approval 10 <br />
