Notification #1600-2018-0342-R3
Streambed Alteration Agreement
October 28, 2019
pile strikes gradually increase energy and frequency of impacts until full force and
frequency are achieved; pipe caissons installed with a vibratory hammer to isolate
the piles from the water; and the use of a bubble curtain surrounding the pile to be
driven.
2.36 Turbidity Curtain. A turbidity curtain shall be used to reduce turbidity caused by in -
water project activities (e.g., pile driving, dewatering, etc.).. After installation of a
turbidity curtain, the Permittee or their contractor shall monitor turbidity during in -
water activities consistent with the 401 Water Quality Certification for the project. If
water quality compliance cannot be achieved with turbidity curtains, then Permittee
shall isolate the in -water demolition area(s) with cofferdams.
3. Compensatory Measures
To compensate for adverse impacts to fish and wildlife resources identified above that cannot
be avoided or minimized, Permittee shall implement each measure listed below.
3.1 Riparian/Tidal Wetland Remediation. Permittee shall provide a riparian/tidal
wetland remediation plan (including initial invasive plant species monitoring,
maintenance and timelines) prepared by a professional habitat restoration
specialist. Permittee shall implement the plan as detailed in the plan's timelines.
This plan must be approved in writing by CDFW prior to commencement of project
activities after January 31, 2020.
3.2 Compensatory Mitigation. Permittee shall provide a comprehensive compensatory
mitigation plan for each habitat type impacted, including hydroacoustic impacts, and
timelines for their completion. This plan must be approved in writing by CDFW and
all compensatory mitigation identified in the plan must either be completed prior to
commencement of project activities after January 31, 2020 or until a security,
approved in form by CDFW in writing, is fully funded for CDFW to carry out any
unmet compensatory mitigation obligations. If Permittee chooses to provide a
security, then a line item estimate for each unmet obligation shall be provided to
calculate the amount of the security.
Water Quality Monitoring. Permittee shall provide a water quality monitoring plan to
ensure the accuracy of models predicting no changes to water quality in the aquatic
habitats upstream of the proposed project. The plan shall focus on summer/fall
months and also identify compensatory mitigation or contingencies to address
impacts to water quality in affected areas. No project activities are authorized to
commence after January 31, 2020 until the water quality monitoring plan has been
accepted in writing by CDFW.
4. Reporting Measures
Permittee shall meet each reporting requirement described below.
4.1 Capture and Relocation. A report of capture and relocation events activities shall
be provided to CDFW within 5 business days after any event occurs. Project
