<br /> B.
<br /> 3 . The Pactor Trashmaster with dozer and the HD24 tractor with dozer
<br /> have not been in operation since July 1, 1977 and October 1, 1977
<br /> respectively.
<br /> 4. Internal roads from the check in building to the dump area were
<br /> not all weather roads in their present condition,
<br /> 5 . No litter fences were evident in the immediate dumping location
<br /> and excessive litter was evident on the site and on surrounding
<br /> properties .
<br /> 6 . Fire has been a problem at the site since October 18 , 1977 . The
<br /> October 18 , 1977 fire was still smoldering on the inspection made
<br /> November 1 , 1977 .
<br /> 7 . The site was secured at the Waverly Road side only.
<br /> C. The following documents condition the design and operation of this
<br /> facility:
<br /> 1. Use Permit Application No. 3295 and No. 3541 issued by the San
<br /> Joaquin County Planning Commision on June 3 , 1965 and February
<br /> 23 , 1966 .
<br /> 2 . Waste Discharge Requirements No. 71-110 adopted October 26 , 1970
<br /> by the California Regional Water Quality Control Board Central
<br /> Valley Region.
<br /> 3 . Permit to Operate #2 issued January 1 , 1977 by the San Joaquin
<br /> Local Health District.
<br /> 4. Rubbish Dump Permit No. 4-0690 issued July 7 , 1977 by the State
<br /> of California Department of Forestry.
<br /> 5 . California Land Conservation Contract No. 71-C1-307 issued April
<br /> 20 , 1971 by San Joaquin County.
<br /> 6 . Contract of Agreement and all Amendments entered into by and between
<br /> San Joaquin County and Nomellini Construction Company on September
<br /> 7 , 1965 , October 26 , 1965 , September 12 , 1967 , July 27 , 1972 and
<br /> December 2 , 1975 .
<br /> D. Land within 1, 000 feet of the site is zoned as follows :
<br /> 1 . GA General Agriculture (San Joaquin County) .
<br /> 2 . A Agriculture (Stanislaus County) .
<br /> E. This facility' s present operations are only partially in compliance
<br /> with State Minimum Standards as determined by a physical inspection
<br /> made on November 1, 1977 . This inspection revealed violations of the
<br /> following Sections : 17636, 17637 , 17638 , 17639 , 17646 , 17647 , 17648 ,
<br /> 17658 , 17660 , 17666 , 17670 , 17676 , 17677 , 17678 , 17679 , 17681, 17682 ,
<br /> 17684, 17685 , 17701, 17703 , 17707 , 17709 , 17711, 17714, 17726 , 17727 ,
<br /> 17731 , 17732 , 17741. The conditions of this permit establish an
<br /> appropriate schedule for compliance with these sections .
