Box 2009 <br />Stockton, CA 95201 SAN X"'.QIj LOCAL <br />HEALTH USTRICT <br />Re: Solid Waste Facility Inspection Foothill Landfill <br />Dear Ms. Heran : <br />As you probably recall, the information package that you recently received, contained <br />a copy of the Presley legislation (SB 1346). This bill authorizes the California <br />Waste Management Board to conduct inspections of solid waste facilities to ensure <br />compliance with the State Minimum Standards for Solid Waste Handling and Disposal. <br />The Board will be inventorying about 20% of all California's solid waste facilities <br />each year. <br />The State Inventory Program, unlike the Federal Open Dump Inventory, will evaluate <br />transfer stations as well as open, closed, and illegal disposal sites. Facilities <br />found to be out of compliance after the first inspection will be allowed a 90 -day <br />grace period for corrections to be made. If compliance is not achieved at the end of <br />90 days, the name of the facility will be subject to designation by the Board as a <br />non -complying solid waste facility. If such a designation is made, the facility will <br />have up to one year to achieve.compliance or the operating permit will be subject to <br />revocation. In the case of closed facilities, the responsible parties will be held <br />to a stricter standard of civil liability in the event the property owner is sued.. <br />My staff would like to inspect the facility(ies) referred to before June 30, <br />1983. These facilities were chosen because they have either had a history of non- <br />compliance, their five year permit review cycle is almost due, or because the Board <br />has not inspected the facility for quite some time. It will be left to your dis- <br />cretion, whether or.not to formally notify them. For your assistance, we have enclosed <br />a sample letter you may wish to use if you choose to notify the operators. <br />We wish to stress that the California Waste Management Board wants to conduct this <br />program in close coordination with you and your staff.
