SU-89-1 page 2 <br /> a. Development fees and school fees of an undetermined amount <br /> will be passed on to first-time purchasers. <br /> b. Homes located on Parcels 1 and 23 must be constructed <br /> to reduce noise levels to be consistent with the County <br /> Ordinance. <br /> C. No residential construction shall occur within 33 feet <br /> of the northern property line adjacent to Eight Mile Road <br /> on Parcels 1 and 23 . <br /> 3 . In lieu of conveyance of park land to the County as prescribed <br /> in Section 9-9261 of the Planning Title, the developer shall <br /> contribute fees of equivalent value as defined in Section <br /> 9-9264 . Arrangements for the payment of said fees shall be <br /> approved by County Counsel prior to final map recordation. <br /> 4 . Pursuant to Section 66474 . 9 of the Subdivision Map Act, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers , or employees to attack, set aside, void, <br /> or annul an approval of the local agency, advisory board, <br /> appeal board, or legislative body concerning a subdivision, <br /> which action is brought within the time provided for in Section <br /> 66499 . 37 of the Subdivision Map Act. <br /> 5 . The storm drainage pond shall be fenced with a minimum <br /> six-foot-high non-climb fence, and landscaped with dense <br /> plantings.
