( 1 ) Any discretionary action by the Staff may be appealed to <br /> the Planning Commission; <br /> ( 2 ) Any action of the Planning Commission may be appealed to <br /> the Board of Supervisors ; <br /> ( c) All appeals shall be filed with the Planning Division on <br /> forms provided by that Division. The appeal shall include , <br /> at a minimum, the following: <br /> ( 1 ) A written statement specifying the basis of the appeal <br /> by citing the specific abuse of discretion by the review <br /> authority; <br /> ( 2 ) A fee as specified in Section 9-1102 ; <br /> dmte Of HM Mi3pe.i , <br /> (d) tet The appeal body shall consider only those items cited in the <br /> appeal . In their deliberation, they may use the record and <br /> any additional evidence relative to the application and may <br /> confirm, reverse , or modify the appealed action based upon <br /> their interpretation of the findings required and the evi- <br /> dence submitted; <br /> (e) +f+ Appeals may be filed only by one of the following: <br /> ( 1 ) The applicant or his or her representative ; <br /> ( 2 ) A person who has participated in the review process by <br /> submitting writen or oral testimony on the application <br /> or by attending a public hearing on the application; <br /> (3 ) A person who was prevented from participating in the <br /> review by circumstances beyond his or her control . <br /> SECTION 5 Section 9-1114 is hereby added to Chapter 5 , <br /> Division 1 , Title 9 , of the San Joaquin County Ordinance Code to read <br /> as follows: <br /> SECTION 9-1114 . REVOCATION OF DISCRETIONARY PERMIT. A <br /> discretionary permit approved under the provisions of this Title <br /> may be revoked for noncompliance with the conditions of the permit <br /> or for the creation of a nuisance as herein defined. The review <br /> procedure for a Discretionary Permit Revocation Proceeding shall <br /> be a public hearing �?X the Planning Commission. A Discretionary <br /> Permit Revocation Proceeding can only be initiated �2y the Planning <br /> Commission or by the Board of Supervisors . <br /> SECTION 6 Section 9-2126 , Chapter 7 , Division 2 , Title 9, <br /> of the San Joaquin County Ordinance Code is hereby repealed: <br /> TA-88-2 - 9 - (BOS : 10-6-87 ) <br />
