EXHIBIT "A" Subdivision No. SU -86-12 October 20, 1987 Public Water Requirements 1. The developer shall pay a fee which represents a proportionate share of the Master Planned Water Facilities to be used for the construction of the facilities and related engineering (which may include the preparation of a Master Plan for the affected area). 2. The fee for the construction of the Master Planned Facilities shall be $2,800 per lot, and will be adjusted annually follow- ing the execution of the Agreement, in accordance with the Engineering News Record Cost Index. 3. Funds collected for the Master Planned Water Facilities shall be placed in an interest-bearing trust account with the County of San Joaquin. 4. Master Planned Water Facilities fees shall be paid for at the time of issuance of a Building Permit. 5. The Agreement shall provide that the funds will be collected for a maximum of 15 years from the date the Agreement is executed. If the public water system is not constructed within 15 years from the date of Agreement execution, the funds, including interest, will be proportionately returned to the owner of the property at that time. 6. In the event that the funds collected are insufficient to construct the Master Planned Water Facilities, the owner of the property will at that time be obligated to pay his proportionate share of the difference. In the event surplus funds are available after construction of the Master Planned Facilities, the funds with interest shall be returned proportionately to the owners of the property at that time; or, at the County's option, placed in the operating account of the County Service Area for the operation and maintenance of the system. 7. Individual private wells, if developed for each lot on an interim basis, shall be constructed in accordance with Local Health District requirements as follows:
