PLANNING COMMISSION MINUTES <br />JULY 16, 1987 <br />4. MAJOR SUBDIVISION APPLICATION NO. SU -87-24 OF LINDA LINDBERG (C/O <br />WONG ENGINEERS, INC.) for a seven (7) lot rural residential sub- <br />division. The property is located on the east side of Fine Road, <br />south of Milton Road, Peters. (Supervisorial District No. 4) <br />Associate Planner James Van Buren introduced a staff report into the <br />record. He noted letters received from County Counsel and Public <br />Works. Mr. Van Buren said that staff was of the view that Finding <br />Nos. 10 and 11 answered the concerns of County Counsel. <br />Supervising Sanitarian Al Olsen noted that Local Health District had <br />some concerns regarding the percolation test. The developer would <br />have to meet percolation test requirements. <br />PUBLIC HEARING OPENED <br />PROPONENTS: Attorney Howard Seligman was present to represent the <br />applicant. He said this issue has been in existence since 1978-79; <br />this present proposal was presented to Mrs. Lindberg by the County to <br />allow her to use her property to utilize the existing RR -65 zoning and <br />the General Plan designation of Rural Residential. This proposal is <br />the result of discussions with the County Administrator's Office, <br />County Counsel and Public Works. The RR -65 zoning will allow develop- <br />ment of seven lots. The 25 -foot strip connecting the property to Fine <br />Road was to be dedicated to the County for the ultimate use as a <br />public roadway. Also, the ditch adjacent to the road was to be dedi- <br />cated to the County as a public drainage channel. The three parcels <br />fronting along the 25 -foot fee strip were sold without requiring addi- <br />tional dedication; the 25 -foot easement does not meet the width <br />requirements for a public roadway that would allow Mrs. Lindberg to <br />develop her seven -lot subdivision. Mrs. Lindberg intends to provide <br />access to her project via "Vacco Road." <br />Mr. Seligman said that the main concern of the property owners in the <br />area is over drainage problems. He asked the Public Works' represen- <br />tative, Mr. Lopez, to explain the recommendation on drainage and its <br />consistency with previous recommendations. Mr. Lopez said it is con- <br />sistent with the Planning Title and does not conflict with standard <br />plans; and that Public Works sees this as a viable method of providing <br />terminal drainage. He said it is not practical to require a County <br />Service Area to maintain a few feet of open ditch along Fine Road; <br />and that would require the developer to provide a study for the <br />drainage. The drainage will go along the north side of Vacco Road. <br />Mr. Seligman said that the developer expects to meet drainage require- <br />ments in order to insure that drainage will go away from the area. <br />Mr. Seligman went on to say that they have hired Kleinfelder and <br />Associates to do additional percolation tests in conformance with <br />Local Health District requirements. <br />PC: 7/16/87 - 4 - MINUTES <br />
