MATERIAL AND WORKMANSHIP
<br />1, UNLESS OTHERWISE SPECIFICALLY PROVIDED IN THESE DOCUMENTS, ALL
<br />EQUIPMENT, MATERIAL, AND ARTICLES INCORPORATED IN THE WORK COVERED BY
<br />THESE DOCUMENTS ARE TO BE NEW AND OF THE MOST SUITABLE GRADE FOR THE
<br />PROCESS INTENDED.
<br />2. CONTRACTOR SHALL NOT DEVIATE FROM MATERIALS OR PRODUCTS SPECIFIED
<br />UNLESS THROUGH MUTUAL AGREEMENT WITH THE OWNER'S CONSTRUCTION MANAGER.
<br />APPROVAL MUST BE IN WRITING, SIGNED BY OWNER'S CONSTRUCTION MANAGER.
<br />SUBSTITUTE MATERIALS SHALL BE DESCRIBED, SPECIFYING ANY DIFFERENCE IN
<br />COST AND PERFORMANCE. ONLY NEW MATERIALS SHALL BE USED. CONTRACTOR
<br />SHALL BE CERTIFIED FOR THE INSTALLATION OF ALL EQUIPMENT AND MATERIALS
<br />CONTAINED IN THIS PROJECT AND THEIR REQ'D. ANCILLARY COMPONENTS.
<br />3. THE CONTRACTOR SHALL FURNISH TO THE OWNER'S REPRESENTATIVE FOR HIS
<br />APPROVAL THE NAME OF THE MANUFACTURER, THE MODEL NUMBER, AND OTHER
<br />IDENTIFYING DATA AND INFORMATION RESPECTING THE PERFORMANCE,
<br />CAPABILITY, NATURE, AND RATING OF THE MACHINERY, MECHANICAL AND OTHER
<br />EQUIPMENT, MATERIAL OR ARTICLES WHICH THE CONTRACTOR CONTEMPLATES
<br />INCORPORATING IN THE WORK WHEN REQUIRED BY THE OWNER'S REPRESENTATIVE.
<br />4. MACHINERY, EQUIPMENT, MATERIAL, AND ARTICLES INSTALLED OR USED WITHOUT
<br />REQUIRED WRITTEN APPROVAL SHALL BE AT THE RISK OF SUBSEQUENT
<br />REJECTION.
<br />5, CONTRACTOR TO PROVIDE ALL MATERIALS NOT LISTED ON THE OWNER'S
<br />SUPPLIED EQUIPMENT LIST, INCLUDING ELECTRICAL COMPONENTS, REQUIRED FOR
<br />A COMPLETE, WORKABLE $ OPERATING FUEL STORAGE AND DISPENSING SYSTEM.
<br />6. CONTRACTOR IS RESPONSIBLE FOR COORDINATING, RECEIVING AND UNLOADING
<br />THE ENTIRE OWNER'S SUPPLIED EQUIPMENT DELIVERED TO CONTRACTOR'S
<br />WAREHOUSE, OR JOB SITE. THE SECURING OF EQUIPMENT REMAINS THE
<br />CONTRACTOR'S RESPONSIBILITY UNTIL THE PROJECT RETAINAGE IS PAID,
<br />CONTRACTOR TO DISTRIBUTE ALL RECEIVING DOCUMENTS TO THE OWNER'S
<br />CONSTRUCTION MANAGER.
<br />-1. ALL WORK TO BE DONE IN ACCORDANCE WITH APPLICABLE CODES AND
<br />REGULATIONS.
<br />O. ALL MATERIALS SHALL BE INSTALLED PER MANUFACTURER'S INSTRUCTIONS AND
<br />THESE DOCUMENTS. CONFLICTS SHALL BE BROUGHT TO THE ATTENTION OF THE
<br />OWNER'S REPRESENTATIVE.
<br />9. IF ANY OF THESE DOCUMENTS INDICATE A CONFLICT WITH THE STATE OR LOCAL
<br />REQUIREMENTS AS ARE CURRENTLY IN EFFECT AT THE TIME OF THIS PROJECT, IT IS
<br />EXPECTED THAT THE MOST RESTRICTIVE CONDITION(S) WOULD APPLY.
<br />GENERAL CONDITIONS
<br />1. CONTRACTOR EMPLOYEES SHALL HAVE COMPLETED 40 HOURS OCCUPATIONAL
<br />SAFETY $ HEALTH ADMINISTRATION (OSHA) TRAINING COURSE PRIOR TO THE
<br />START OF WORK. CERTIFICATION OF THIS MUST BE PROVIDED TO THE OWNER'S
<br />REPRESENTATIVE PRIOR TO THE START OF WORK.
<br />2. FUEL SYSTEM CONTRACTORS AND EMPLOYEE INSTALLERS SHALL HAVE ALL
<br />CURRENTLY REQUIRED EQUIPMENT MANUFACTURERS' CERTIFICATIONS 4 APPROVALS
<br />FOR INSTALLATION OF ALL OF THE FUEL SYSTEM RELATED WORK, INCLUDING FUEL
<br />SYSTEM ELECTRICAL COMPONENTS, (INCLUDING, BUT NOT LIMITED TO TANKS, PIPING,
<br />SUMPS, DISPENSERS, MONITORING, COMMUNICATIONS AND ELECTRICAL) AND SHALL
<br />PROVIDE A COMPLETE, WORKABLE FUEL SYSTEM PER MANUFACTURERS' s CODES'
<br />REQUIREMENTS, AND IN ACCORDANCE WITH, BUT NOT LIMITED TO, CALIFORNIA
<br />UNDERGROUND STORAGE TANK (UST) REGULATIONS 4 CALIFORNIA AIR RESOURCES
<br />BOARD (CARB)REQUIREMENTS. CERTIFICATES SHALL BE PROVIDED TO OWNER.
<br />CONTRACTOR SHALL COMPLETE THE INSTALLATION CHECKLISTS SUPPLIED BY
<br />MANUFACTURERS AND SHALL FURNISH THE CHECKLISTS TO OWNER.
<br />3. CONTRACTOR SHALL HAVE THE FOLLOWING LICENSES:
<br />A: GENERAL ENGINEERING (A)
<br />B: HAZARDOUS MATERIAL SUBSTANCE HANDLING (HAZ)
<br />4. CONTRACTOR SHALL HAVE THE FOLLOWING INSURANCE. CONTRACTOR SHALL
<br />HAVE PROOF OF SUCH INSURANCE ON FILE WITH OWNER BY NAMING OWNER AS
<br />"ADDITIONAL INSURED"
<br />A: STATUTORY WORKMAN'S COMPREHENSIVE LIABILITY
<br />B: GOMPREHENSIVE GENERAL LIABILITY, WITH A COMBINED SINGLE LIMIT OF NOT
<br />LESS THAN $1,000,000 PER OCCURRENCE FOR BODILY INJURY AND PROPERTY
<br />DAMAGE.
<br />C: AUTOMOBILE LIABILITY COVERING USE OF ALL OWNED OR HIRED VEHICLES
<br />WITH A COMBINED SINGLE LIMIT OF LIABILITY OF NOT LESS THAN $1,000,000 PER
<br />OCCURRENCE FOR BODILY INJURY AND PROPERTY DAMAGE.
<br />5. CONTRACTOR TO FURNISH ALL LABOR, MATERIAL, EQUIPMENT, AND SERVICES
<br />NECESSARY FOR OR REASONABLY INCIDENTAL TO THE SATISFACTORY
<br />COMPLETION OF ALL WORK SHOWN ON, CALLED FOR, OR REQUIRED BY THE
<br />DRAWINGS, EXCEPT AS NOTED AS SUPPLIED BY OWNER OR OTHERS.
<br />ro. ALL WORK SHALL BE PERFORMED IN ACCORDANCE WITH THE CALIF. BUILDING
<br />CODE, CALIFORNIA FIRE CODE, CALIFORNIA ELECTRICAL CODE, CALIFORNIA
<br />UNDERGROUND STORAGE TANK REGULATIONS, OSHA CONSTRUCTION SAFETY
<br />ORDERS, NATIONAL FIRE PROTECTION 4550C. (NFPA), UNDERWRITER'S
<br />LABORATORIES, INC. (UL), GARB EXECUTIVE ORDERS AND GUIDANCE LETTERS
<br />AND ANY OTHER APPLICABLE STANDARD OR STATE REGULATION, COUNTY OR
<br />CITY ORDINANCES.
<br />T ALL FUEL SYSTEM PERMITS TO BE SECURED BY THE CONTRACTOR, WHO IS
<br />RESPONSIBLE FOR COMPLYING WITH ALL PERMIT CONDITIONS. CONTRACTOR
<br />SHALL SECURE MISCELLANEOUS ELECTRICAL PERMIT UNLESS WORK IS COVERED
<br />BY OTHER BUILDING PERMITS FOR THE PROJECT.
<br />8. CONTRACTOR SHALL VISIT SITE AND FAMILIARIZE HIMSELF OF ALL EXISTING
<br />CONDITIONS PRIOR TO START OF CONSTRUCTION.
<br />S. CONTRACTOR SHALL PROTECT ALL EXISTING FACILITIES TO REMAIN UNLESS
<br />NOTED OTHERWISE. CONTRACTOR SHALL REPAIR OR REPLACE TO THE
<br />SATISFACTION OF THE OWNER'S REPRESENTATIVE ANY EXISTING FACILITIES THAT
<br />ARE DAMAGED BY THE CONTRACTOR'S OPERATIONS.
<br />10. CONTRACTOR SHALL KEEP THE SITE FREE OF WASTE AND RUBBISH AT ALL TIMES.
<br />CONTRACTOR SHALL HAVE THE WORK AREA PROFESSIONALLY CLEANED THE DAY
<br />BEFORE THE OWNER'S FINAL PROJECT INSPECTION.
<br />11. WHEN AN INSTALLATION IS MADE AT AN EXISTING STORE, THE CONTRACTOR IS TO
<br />SCHEDULE AND PERFORM HIS WORK SO AS NOT TO INTERFERE WITH THE NORMAL
<br />STORE OPERATIONS. ALL DEBRIS, EXCESS EXCAVATION MATERIALS, MACHINERY
<br />AND EQUIPMENT TO BE REMOVED AND MAINTAINED CLEAR OF THE DRIVEWAYS
<br />THAT ARE IN USE EACH DAY AND LIGHTED BARRICADES SHALL BE PROVIDED
<br />FOR THE PUBLIC'S PROTECTION. WHEN IT BECOMES NECESSARY TO CLOSE A
<br />DRIVEWAY FOR MORE THAN 24 HOURS, THE CONTRACTOR WILL PROVIDE
<br />TEMPORARY TRAVEL SERVICE FOR TRAFFIC.
<br />12. A COPY OF THE SPECIFICATIONS AND DRAWINGS, ALONG WITH APPROVED SITE
<br />PLAN, WITH AS -BUILT NOTATIONS, SHALL BE ON SITE AT ALL TIMES.
<br />13. CONTRACTOR IS RESPONSIBLE FOR ANY PRODUCT IN TANKS AND IN LINES UNTIL
<br />LOCATION OPENS OR REOPENS FOR GASOLINE BUSINESS. ANY PRODUCT LOSS
<br />DURING CONSTRUCTION SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR.
<br />PRIOR TOPROJECT ACCEPTANGE, THE OWNER SNA LL RECONCILE INVENTORY BY
<br />COMPARING PRODUCT IN TANKS AND LINES TO AMOUNT DELIVERED. SHORTAGES
<br />SHALL BE BILLED TO CONTRACTOR AT FULL RETAIL PRICE.
<br />14. CONTRACTOR MUST PROVIDE ADEQUATE PROVISIONS TO MITIGATE RAIN DAMAGE
<br />AND DELAYS (I.E. PUMPS, TARPS, ETC.).
<br />15. UPON COMPLETION OF PROJECT, CONTRACTOR SHALL PROVIDE OWNER WITH
<br />"AS -BUILT" DRAWINGS OF ALL ITEMS INSTALLED BY SAME. "AS GUILTS" SHALL BE
<br />COMPLETED ON-SITE WITH INFORMATION NOTED DIRECTLY ON APPROVED JOB
<br />COPY.
<br />16. CONTRACTOR TO WARRANTY ALL WORKMANSHIP AND CONTRACTOR SUPPLIED
<br />MATERIAL FOR I YEAR. THE OWNER SHALL PERFORM A 10 MONTH WARRANTY
<br />INSPECTION TO EVALUATE CONTRACTOR PERFORMANCE AND QUALITY OF
<br />WORKMANSHIP. CONTRACTOR MUST COMPLETE ALL PUNCH LIST ITEMS IDENTIFIED
<br />DURING THIS 10 MONTH INSPECTION.
<br />1-1. CONTRACTOR SHALL PROVIDE A LIST OF SUB -CONTRACTORS, IF ANY, WHO WILL BE
<br />USED ON THE PROJECT, IF REQUIRED.
<br />18. CONTRACTOR IS TO SCHEDULE ALL SUBCONTRACTORS, INCLUDING THOSE
<br />CONTRACTED DIRECTLY WITH THE OWNER'S CONSTRUCTION MANAGER. THE OWNER
<br />WILL PROVIDE A LIST OF SUBCONTRACTORS, CONTACTS AND PHONE NUMBERS,
<br />FOR THOSE SUBCONTRACTORS THAT HAVE CONTRACTS DIRECTLY WITH THE
<br />OWNER,
<br />19. CONTRACTOR SHALL COORDINATE ALL INSPECTIONS AND APPROVALS AND
<br />OBTAIN, AT THE COMPLETION OF THE PROJECT, ALL CERTIFICATES REQUIRED TO
<br />RUN THE FACILITY.
<br />20. CONTRACTOR SHALL PLACE THE HIGHEST PRIORITY ON SAFETY AND HEALTH
<br />DURING THE PROGRESS OF WORK PERFORMED AT THE OWNER'S STORE
<br />LOCATIONS. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO PROVIDE
<br />AND MAINTAIN A SAFE WORKING ENVIRONMENT FOR ITS EMPLOYEES DURING THE
<br />PROGRESS OF WORK AND TO PROTECT THE HEALTH AND SAFETY OF
<br />CONTRACTOR'S AGENTS, SUBCONTRACTORS, THE PUBLIC AND ANY THIRD PARTIES.
<br />ALL TOOLS, MATERIALS, EQUIPMENT, FACILITIES AND OTHER ITEMS USED BY THE
<br />CONTRACTOR AND PRACTICES EMPLOYED BY THE CONTRACTOR IN
<br />ACCOMPLISHING THE WORK ARE CONSIDERED TO BE PART OF THE WORKING
<br />ENVIRONMENT.
<br />21. CONTRACTOR TO KEEP ON SITE MATERIAL SAFETY DATA SHEETS (MSC)5) FOR
<br />CHEMICAL COMFOUNID5 REGULATE]--) THROUGH U.S.E P.A. THAT WILL BE USED
<br />ON-SITE OR HAS THE POTENTIAL FOR HUMAN CONTACT (I.E., GASOLINE, DRY ICE,
<br />SOLVENTS, GLUES, ETC.)
<br />22. WHILE ON SITE AND DURING WORKING HOURS, CONTRACTOR'S PERSONNEL MUST
<br />WEAR SHIRTS, LONG PANTS, HARD HATS WHEN REQUIRED, AND ACCEPTABLE FOOT
<br />WEAR PER OSHA, REGULATIONS.
<br />23. CONTRACTOR TO DEVELOP A SPECIFIC SITE SAFETY PLAN FOR TANK AND
<br />EQUIPMENT INSTALLATION PRIOR TO THE START OF WORK. CONTRACTOR WILL
<br />CONDUCT WEEKLY JOB SITE SAFETY MEETINGS WITH ITS EMPLOYEES AND THE
<br />MEETING MINUTES WILL BE SUPPLIED TO OWNER.
<br />24, SAFETY PLAN: CONTRACTOR SHALL DEVELOP AND MAINTAIN FOR THE DURATION
<br />OF THE CONTRACT A SITE HEALTH 4 SAFETY PLAN (SAFETY PLAN) THAT WILL
<br />EFFECTIVELY INCORPORATE AND IMPLEMENT REQUIRED SAFETY PROVISIONS, AND:
<br />A: APPOINT AN EMPLOYEE AS THE SAFETY OFFICER WHO IS QUALIFIED AND
<br />AUTHORIZED TO SUPERVISE AND ENFORCE COMPLIANCE WITH THE SAFETY PLAN.
<br />SUBMIT THE NAME AND QUALIFICATIONS OF THE SAFETY OFFICER TO THE OWNER'S
<br />REPRESENTATIVE PRIOR TO COMMENCING WORK ON THE SITE.
<br />B: THE SAFETY PLAN SHALL CONTAIN THE NAMES, ADDRESSES AND TELEPHONE
<br />NUMBERS OF THE SUPERVISORY PERSONNEL, THE HOSPITAL FACILITIES NEAREST
<br />THE SITE, AND A MAP TO THE HOSPITAL. PROCEDURES SHALL BE WRITTEN IN THE
<br />SAFETY PLAN FOR ACTIONS TO BE TAKEN SHOULD STRANGE ODORS OR
<br />HAZARDOUS SUBSTANCES BE UNCOVERED.
<br />C. IF, DURING THE COURSE OF THE WORK, UNSAFE CONDITIONS DEVELOP OR ARE
<br />ENCOUNTERED, TAKE IMMEDIATE MEASURES TO CORRECT THE CONDITION. IF THE
<br />CORRECTIVE ACTION IS INSUFFICIENT IN THE OPINION OF THE OWNER'S
<br />REPRESENTATIVE, CONSTRUCTION WORK SHALL CEASE UNTIL CORRECTIVE ACTION
<br />CAN BE IMPLEMENTED.
<br />D: PROVIDE A MINIMUM OF TWO FIRE EXTINGUISHERS WITH A MINIMUM CLASS
<br />RATING OF 2 -A20 -5:C WITHIN 50 FEET OF THE OPERATION.
<br />25. UNDERGROUND SERVICE ALERT (U.S.A.) - THE CONTRACTOR SHALL NOTIFY
<br />MEMBERS OF U.S.A. AT LEAST 2 FULL WORKING DAYS (BUT NOT MORE THAN 14 DAYS)
<br />IN ADVANCE OF PERFORMING ANY EXCAVATION WORK BY CALLING THE TOLL-FREE
<br />ONE -GALL PROGRAM NUMBER 8-1-1 OR (800) 22-1-2(o00.
<br />EXCAVATION
<br />I. ALL EXCAVATIONS SHALL BE PERFORMED IN COMPLIANCE WITH OSHA AND STATE
<br />REGULATIONS. THE CONTRACTOR IS REFERRED TO THE OSHA BOOKLET,
<br />"EXCAVATING AND TRENCHING OPERATIONS", FOR A SAFE WORK PRACTICES GUIDE
<br />FOR PERFORMING EXCAVATION WORK.
<br />2. EXCAVATION SHALL BE SIZED PER TANK MANUFACTURER'S GUIDELINES. PIPELINE
<br />TRENCHING SHALL BE PER PIPELINE MANUFACTURER'S GUIDELINES
<br />3. THE OWNER RESERVES THE RIGHT TO DESIGN AND/OR CONSTRUCT SHORING UNDER
<br />AN AMENDED AGREEMENT WITH CONTRACTOR OR SEPARATELY WITH ANOTHER
<br />COMPANY, IF THE OWNER ENGAGES CONTRACTOR, CONTRACTOR SHALL SUBMIT
<br />SHORING DESIGN TO THE OWNER'S CONSTRUCTION MANAGER FOR APPROVAL.
<br />SUPPLEMENTAL JOB SCOPE AND COST SHALL BE AGREED TO IN TERMS OF A
<br />CONTRACT CHANGE ORDER PRIOR TO COMMENCING WORK. SNORING SHALL BE
<br />REMOVED PRIOR TO INSTALLING PRODUCT PIPING UNLESS APPROVED BY THE
<br />OWNER'S CONSTRUCTION MANAGER TO ABANDON IN PLACE.
<br />4. UNSTABLE SOILS MAY BE REQUIRED TO HAVE A FILTER FABRIC EXCAVATION
<br />LINER. CONSULT BID DOCUMENTS OR THE OWNER'S CONSTRUCTION MANAGER FOR
<br />SPECIFIC INFORMATION REGARDING THIS ISSUE.
<br />5. MINIMIZE SURFACE WATER ENTERING EXCAVATIONS BY CONSTRUCTING DIVERSION
<br />DAMS AROUND TANKFIELD EXCAVATION AND PIPING TRENCHES.
<br />6. A CONTINGENCY PLAN SHALL BE DEVELOPED WITH THE OWNER'S CONSTRUCTION
<br />MANAGER OUTLINING EMERGENCY PROCEDURES FOR OBTAINING THE NECESSARY
<br />EQUIPMENT AND/OR PERSONNEL TO HANDLE UNEXPECTED WATER ENTRY INTO THE
<br />TANK FIELD EXCAVATION OR PIPING TRENCHES. WHEN WATER MAY CONTAIN
<br />HYDROCARBONS, CONSULT THE OWNER'S CONSTRUCTION MANAGER PRIOR TO
<br />REMOVING IT FROM SITE.
<br />FUEL SYSTEM WORK SCOPE
<br />1. PRIOR TO THE START OF WORK, PROVIDE OWNER WITH WORK PLAN AND SCHEDULE
<br />THAT COORDINATES SCHEDULING WITH OTHER PORTIONS OF THE PROJECT TO THE
<br />FULLEST EXTENT POSSIBLE.
<br />2. CONTRACTOR SHALL COORDINATE DELIVERY DATE OF TANKS WITH THE
<br />MANUFACTURER, THE OWNER'S CONSTRUCTION MANAGER, AND THE PROJECT
<br />SCHEDULE.
<br />3. CONTRACTOR TO PROVIDE (o' CHAIN LINK SECURITY FENCING AND BARRICADES
<br />DURING ALL CONSTRUCTION PHASES, OR AS DIRECTED BY THE OWNER'S
<br />CONSTRUCTION MANAGER. POST "KEEP OUT" SIGNS ON FENCE EVERY 30 FEET. AT
<br />THE END OF EACH WORK DAY SECURE FENCING PANELS TOGETHER.
<br />4. EXCAVATE AS NECESSARY FOR THE INSTALLATION OF NEW FUEL EQUIPMENT, TANKS,
<br />PIPING, FUEL SYSTEM CONDUITS, AND ANCILLARY FUEL SYSTEM COMPONENTS.
<br />5. WHEN SOIL IS TO BE STOCKPILED ON SITE FOR SAMPLING PRIOR TO OFF -HAUL,
<br />FUEL SYSTEM CONTRACTOR SHALL PLACE EXCAVATED SOIL ON AND SHALL
<br />COVER WITH 4 MIL. PLASTIC UNTIL SOIL IS REMOVED, IN AREA TO BE APPROVED
<br />BY OWNER / GENERAL CONTRACTOR (G.C.). G.C. SHALL PROVIDE FOR
<br />DISTRIBUTION OF ALL EXCAVATED SOIL, PER GENERAL PROJECT REQUIREMENTS.
<br />6. INSTALL "TYPAR" FILTER FABRIC LINER IN TANK HOLE AND TRENCHES, WHERE
<br />REQUIRED BY WET -HOLE OR UNSTABLE SOIL CONDITIONS. INSTALL TANK
<br />HOLD-DOWNS IF STATED AS INCLUDED BY THE DRAWINGS.
<br />T. THE OWNER'S CONSTRUCTION MANAGER SHALL WITNESS PRE -INSTALLATION TANK
<br />TESTING. CONTRACTOR SHALL NOTIFY THE OWNER'S CONSTRUCTION MANAGER TWO
<br />WORKING DAYS PRIOR TO TESTING AND TANK INSTALLATION.
<br />8. TANK MANUFACTURER'S INSTALLATION PROCEDURE SHALL BE FOLLOWED, AND THE
<br />INSTALLATION CHECKLIST SHALL BE INITIALED/SIGNED BY CONTRACTOR AND THE
<br />OWNER'S CONSTRUCTION MANAGER, AS APPROPRIATE, AS EACH STEP IS
<br />COMPLETED.
<br />9. AN UNDERGROUND EQUIPMENT INSTALLATION AFFIDAVIT SHALL BE FILLED OUT BY
<br />CONTRACTOR AND SUBMITTED TO THE OWNER'S CONSTRUCTION MANAGER IN
<br />BOUND PROJECT CLOSE OUT FOLDER.
<br />10, CONTRACTOR TO PROVIDE REQUIRED TEST MANIFOLDS PER MANUFACTURER'S
<br />NSTRUCTIONS AND SPECIFICATIONS. PRESSURE GAUGES SHALL BE IN GOOD

<br />TESTING
<br />1. OWNER'S REPRESENTATIVE SHALL WITNESS ALL TESTING AT NIS/HER DISCRETION.
<br />CONTRACTOR SHALL NOTIFY THE OWNER'S REPRESENTATIVE AT LEAST TWO DAYS
<br />PRIOR TO ANY TESTING, IN WRITING.
<br />2. ALL TESTING SHALL COMPLY WITH MANUFACTURER'S INSTRUCTIONS AND
<br />REQUIREMENTS, TRADE STANDARDS AND GOVERNING RULES AND CODES,
<br />INCLUDING THE USE OF CERTIFIED AND APPROVED INDEPENDENT THIRD PARTY
<br />TESTERS, WHEN REQUIRED.
<br />3. FINAL TESTING SHALL BE CONDUCTED BY A THIRD PARTY TESTING COMPANY
<br />SUBCONTRACTED TO THE FUEL SYSTEM CONTRACTOR. TESTING METHODS MUST BE
<br />APPROVED BY THE OWNER'S CONSTRUCTION MANAGEMENT AND CONFORM TO ALL
<br />REGULATIONS AND CODES. FUEL SYSTEM CONTRACTOR SHALL SCHEDULE AND
<br />COORDINATE THE TESTING CONTRACTOR ALONG WITH ANY LOCAL INSPECTIONS
<br />REQUIRED TO OPEN THE SITE/STORE. FUEL SYSTEM CONTRACTOR SHALL HAVE A
<br />REPRESENTATIVE ON-SITE DURING ALL TESTING.
<br />4. ANY COSTS ASSOCIATED WITH FAILED TESTS AND SUBSEQUENT REPAIRS /
