a <br /> f <br /> 02/10/99 - Steve Mindt sent letter to Alan Coons. The letter addressed comments that <br /> were made by Mr. Coons in the letter to Dee Anne Watkins. The letter <br /> requested that Cal State Mortgage supply PHS-EHD with a work-plan to clean <br /> up the property. The letter re-stated the directives of the letter from EHD <br /> dated 12/30/98. <br /> 05/10/99 - Letter to Alan Coons from Mike Huggins indicating that EHD must receive a <br /> work-plan from Cal State Mortgage within 30 days or a Notice and Order will <br /> be issued. <br /> 11/05/99 -Meeting with Dee Anne Watkins of San Joaquin County Counsel to determine <br /> how to proceed with further enforcement action. <br /> 11/08/99 - Conducted an annual routine inspection to determine site status. Three <br /> Violations were cited. The violations were noted in the following areas: Site <br /> Security, Site Maintenance, and Litter Control. <br /> 04/10/00—The EHD issued Notice and Order 00-01. The Notice and Order cited the <br /> property for accumulation of solid waste, for being a public nuisance, litter <br /> control, disposal on premises, containers required and having no disposal area <br /> permit for the site. <br /> 05/18/00—The EHD received a letter from the Kirk Law Firm. The letter explained the <br /> situation under which the property was acquired by Delta Funding and some <br /> of the recent changes within Delta Funding. The letter explained that Delta <br /> Funding would like to meet with the EHD prior to any further action was <br /> taken. The letter explained that they would like to see if resolution could be <br /> met. <br /> 06/08/00—Meeting with Sherri M. Kirk of the Kirk Law Firm and Peter Bednarek <br /> representing Delta Funding LTD PTP,Dee Anne Watkins of County Counsels <br /> Office, Mike Huggins and Robert McClellon of the EHD. The site status was <br /> discussed. Sherri M. Kirk argued that lender liability exclusion would apply <br /> and that Delta Funding would not be responsible for any cleanup. Dee Anne <br /> Watkins did not agree with that assertion. Peter Bednarek stated that they <br /> foreclosed on the property and would like to get out from under it. Peter <br /> Bednarek and Sherri Kirk were concerned that the Notice and Order would <br /> not allow them sell the property. Dee Anne Watkins indicated that the <br /> property could be sold. Dee Anne Watkins also indicated that Delta Funding <br /> or the new owners could satisfy the requirements of the Notice and Order. <br /> The meeting ended with Delta Funding agreeing to have the site secured, <br /> having the site surveyed, removing surface debris, and based on the outcome <br /> of the survey doing an investigation on the sub-surface burial of solid waste. <br />
