• Phasing of areas from agricultural to urban use—locations and time frames; <br /> • Irrigation water supply and service plan approved by BBID; <br /> • BBID encroachment permits; <br /> • Temporary buffering that includes a 100-foot setback between the edge of <br /> development and ongoing agricultural operations as the project builds out; <br /> • Permanent setbacks; <br /> • Landscape buffers; and <br /> • Fencing, signage or other suitable measures to minimize noise, spray drift and limit <br /> the potential for trespass on agricultural lands and BBID facilities. <br /> In addition, the plan shall address the following: <br /> • Chemical applications <br /> • Dust management <br /> Timing: condition shall be met prior to approval of the first Final Map. Right To Farm Recordation And Notification: The deed of each parcel and of each <br /> condominium unit shall include the following recording notification, as specified by San <br /> Joaquin County Ordinance 4217 which added Section 6-9004 et. seq. to Chapter 1 of <br /> Division 9 of the San Joaquin County Ordinance Code regarding the Right to Farm <br /> Notice: "All persons purchasing lots within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin County <br /> has determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance." <br /> Timing: Prior to approval of Final Map. <br /> NOISE <br /> 23. Noise Study: A Noise Study shall be required in those areas exposed to exterior noise <br /> levels exceeding an Ldn of 60 dB, as indicated in the Specific Plan II Initial Study. Said <br /> Noise Study shall address how noise levels in outdoor use areas (e.g., backyards, patios, <br /> and decks)could be maintained at or below an Ldn of 60 dB. [Master Plan <br /> Implementation 11.3 (c); SPII Implementation Measure 11.2.1 (2)] <br /> Timing: Prior to issuance of building permits. <br /> 24. Outdoor Noise Levels: Best available noise reduction measures shall be implemented <br /> by the applicant to reduce noise levels in primary outdoor use areas (backyards) of new <br /> residential development to an Ldn of 60 dB. Where it is not possible to reduce noise <br /> levels to this level using practical application of the best available noise reduction <br /> measures, an exterior noise level of up to 65 db may be allowed. [Master Plan Policy <br /> 11.3.1 (e)] In the case that noise levels cannot be reduced to the design noise level of 60 <br /> dB, the applicant must provide notice via a note on the deed of each lot stating that <br /> exterior noise levels may exceed 60 dB. <br /> Timing: Inclusion of note on the final map approved by CDD prior to Final Map approval, <br /> and inclusion of note on deed prior to issuance of building permits. <br /> 25. Interior Noise Levels: Interior noise levels for housing proposed to be located in areas <br /> exposed to an exterior noise level of an Ldn above 60 dB shall be maintained at or below <br /> an Ldn of 45 dB.
