Financial responsibility <br /> (a) Cost Estimate for facility post-closure. <br /> (1) As required in 40 CFR 264.142 and 264.144, <br /> the owner or operator shall have a written <br /> estimate of the cost of post-closure ac- <br /> tivities for the facility in accordance with <br /> the "Post-Closure Monitoring Plan. " <br /> (2) The owner or operator shall prepare a new <br /> post-closure cost estimate whenever a change <br /> in the post-closure plan affects the cost .of <br /> post-closure. <br /> (3) On each anniversary of the effective date of <br /> this permit, the owner or operator shall ad- <br /> just the latest post-closure cost estimate <br /> using an inflation factor derived from the <br /> annual Implicit Price Deflator for Gross Na- <br /> tional Product as published by the U.S. <br /> Agency of Commerce in its SURVEY OF CURRENT <br /> BUSINESS. The inflation factor shall be cal- <br /> culated by dividing the latest published an- <br /> nual Deflator for the previous year. The <br /> result is the inflation factor. The adjusted <br /> post-closure cost estimate shall equal the <br /> latest post-closure cost estimate times the <br /> inflation factor. <br /> (4) The adjusted post-closure cost estimate shall <br /> be submitted to the Agency as part of the an- <br /> nual report (see permit condition VII.3) . <br /> (b) Financial assurance for facility closure and <br /> post-closure care. <br /> (1) Financial Assurance <br /> The owner or operator shall demonstrate to <br /> the Agency continuous compliance with ap- <br /> plicable sections of 40 GFR 264. 145, by <br /> providing documentation of financial as- <br /> surance in at least the amount of the cost <br /> estimates required by item 5(a) . <br /> (2) Liability <br /> The owner or operator shall demonstrate to <br /> the Agency continuous compliance with 40 CFR <br /> 264. 147 by providing documentation of <br /> liability coverage in the required amounts. <br /> 14 <br />
