CAD 990 794 133 Modification 0 An owner or operator who fulfills the re- quirements above will be deemed to be without the required financial assurance and liability coverage in the event of a bankruptcy, insolvency, or a suspension or revocation of the license or charter of the issuing institution. The owner or operator must obtain other financial assurance / liability coverage within 60 days of such events. The owner or operator shall comply with all of the financial responsibility and facility closure requirements of the Agency when enacted. If the financial requirements for closure or post-closure exceed estimated amounts, the owner or operator shall obtain additional or increased performance bonds and notify the Agency of such activities. - III. GROUND WATER MONITORING 1. REQUIRED PROGRAMS (a) The Owner/Operator must conduct a monitoring and response program as follows: (i) Whenever hazardous constituents under 40 CFR 264.93 from a regulated unit are detected at the compliance point under 40 CFR 264.95, the owner or operator must institute a compliance monitoring program under 40 CFR 264.99 and Permit Condition III.6(f) . Detected is defined as statistically significant evidence of contamination-as described in 40 CFR 264.98 (f) .. At the effective date of this permit, no significant concentrations of haz- ardous constituents from the regulated unit have been detected. (ii) Whenever the ground water protection standard under 40 CFR 264.92 is exceeded, the owner or operator must institute a corrective action program under 40 CFR 264.100. Exceeded is defined as statistically significant evidence of increased contamination as described in 40 264.99(d) ; (iii) Whenever hazardous constituents under 40 CFR 264.93 from a regulated unit exceed con- centration limits under 40 CFR 264.94 in ground water between the compliance point un- der 40 CFR 264.95 and the downgradient 15
