CAD 990 794 133 Modification 0 <br /> An owner or operator who fulfills the re- <br /> quirements above will be deemed to be without <br /> the required financial assurance and <br /> liability coverage in the event of a <br /> bankruptcy, insolvency, or a suspension or <br /> revocation of the license or charter of the <br /> issuing institution. The owner or operator <br /> must obtain other financial assurance / <br /> liability coverage within 60 days of such <br /> events. <br /> The owner or operator shall comply with all <br /> of the financial responsibility and facility <br /> closure requirements of the Agency when <br /> enacted. If the financial requirements for <br /> closure or post-closure exceed estimated <br /> amounts, the owner or operator shall obtain <br /> additional or increased performance bonds and <br /> notify the Agency of such activities. - <br /> III. GROUND WATER MONITORING <br /> 1. REQUIRED PROGRAMS <br /> (a) The Owner/Operator must conduct a monitoring and <br /> response program as follows: <br /> (i) Whenever hazardous constituents under 40 CFR <br /> 264.93 from a regulated unit are detected at <br /> the compliance point under 40 CFR 264.95, the <br /> owner or operator must institute a compliance <br /> monitoring program under 40 CFR 264.99 and <br /> Permit Condition III.6(f) . Detected is <br /> defined as statistically significant evidence <br /> of contamination-as described in 40 CFR <br /> 264.98 (f) .. At the effective date of this <br /> permit, no significant concentrations of haz- <br /> ardous constituents from the regulated unit <br /> have been detected. <br /> (ii) Whenever the ground water protection standard <br /> under 40 CFR 264.92 is exceeded, the owner or <br /> operator must institute a corrective action <br /> program under 40 CFR 264.100. Exceeded is <br /> defined as statistically significant evidence <br /> of increased contamination as described in 40 <br /> 264.99(d) ; <br /> (iii) Whenever hazardous constituents under 40 CFR <br /> 264.93 from a regulated unit exceed con- <br /> centration limits under 40 CFR 264.94 in <br /> ground water between the compliance point un- <br /> der 40 CFR 264.95 and the downgradient <br /> 15 <br />
