REOUEST FOR PERMIT MODIFICATION <br /> If the Owner/Operator or the Director determines the <br /> detection monitoring program no longer satisfies the <br /> requirements of the regulations, the Owner/Operator <br /> must, within 90 days of the determination, submit an <br /> application for a permit modification to make any ap- <br /> propriate changes to the program which will satisfy the <br /> regulations. (40 CFR 264.98(h) ] <br /> IV. INSPECTIONS <br /> (a) The owner or operator shall inspect the facility for <br /> malfunctions, erosion, deterioration, and discharges <br /> which may be causing -- or may lead to -- release of <br /> hazardous waste constituents to the environment or a <br /> threat to human health. The owner or operator shall <br /> conduct these inspections often enough to identify <br /> problems in time to correct them before they harm human <br /> health or the environment. <br /> (b) (1) The owner or operator shall follow the written <br /> schedule in the "Post-Closure Monitoring Plan" for <br /> inspecting all monitoring equipment, safety equip- <br /> ment, security devices, and structural devices <br /> that are important to preventing, detecting, or <br /> responding to environment or human health hazards. <br /> (2) The owner or operator shall keep this schedule at <br /> the location identified in the "Post-Closure <br /> Monitoring Plan" which will be maintained on the <br /> facility with other documents required to be main- <br /> tained by this permit. <br /> (c) The owner or operator shall remedy any deterioration or <br /> malfunction of equipment or structures which has been <br /> identified during an inspection. All remedial actions <br /> shall ensure that the problem does not lead to an en- <br /> vironmental or human health hazard. Where a hazard is <br /> imminent or has already occurred, remedial action shall <br /> be taken immediately. The Agency must be notified in <br /> writing within five business days of any remedial ac- <br /> tions. <br /> (d) The owner or operator shall record inspection in an in- <br /> spection log or summary. He shall keep these records <br /> for at least three years from the date of inspection. <br /> At a minimum, these records shall include the date and <br /> time of the inspection, the name of the inspector, a <br /> notation of the observations made, and the date and na- <br /> ture of any repairs or other remedial actions. <br /> 28 <br />
