MHCSD Impact Fees (CFF and TIF): Prior to issuance of each building permit, the Developer <br /> shall comply with the applicable requirements of the most current MHCSD adopted CFF and <br /> TIF Ordinances and Fees in effect at the time the building permit is issued. <br /> ffff. The Developer shall pay all other permitting fees as applicable at the time of issuance of building <br /> permits. <br /> gggg.O & M Vehicles: Prior to the issuance of the first building permit developers will deposit in a <br /> MHCSD Maintained Vehicle Capital Fund an amount equal to their pro-rata share (based on <br /> the CFF Plan Fee formula as determined by the MHCSD)of the total cost of O&M Vehicles as <br /> that cost is specified in the latest update of the CFF Plan Fees. <br /> hhhh. Police and Fire Vehicles: Prior to issuance of the first building permit developers will deposit in <br /> a CSD Maintained Vehicle Capital Fund an amount equal to their pro-rata share (based on the <br /> CFF Plan Fee formula as determined by the MHCSD) of the total cost of Police and Fire <br /> Vehicles as that cost is specified in the latest update of the CFF Plan Fees. <br /> iiii. Developer agrees to cooperate in the formation of, or annexation into, a community facilities <br /> district or districts (the "Services CFD") established pursuant to the Mello-Roos Community <br /> Facilities District Act of 1982 (Gov. Code §§ 53311-53368.3) (the"Mello-Roos Act") including <br /> approval of the Rate, Method of Apportionment and Manner of Collection of Special Tax ("RMA") <br /> for the purpose of financing the services and maintenance of certain public <br /> facilities/improvements, specifically including maintenance of open space, landscaping, trails and <br /> habitat, and parks. Developer agrees that the boundaries of the Services CFD will include all of <br /> the Property, and that Developer will not contest and will, for and on behalf of all of the Property, <br /> vote in favor of formation of or annexation into the Services CFD prior to filing the first final map. <br /> Developer shall pay its fair share of administrative costs incurred by the District associated with <br /> the formation of and/or annexation into the Services CFD, as determined by the District Engineer. <br /> If formed prior to July 1, 2024, the District agrees that the amount of the services special tax will <br /> not exceed $533 per residential unit in the first year, with subsequent years being subject to <br /> typical inflationary adjustments as may be specified the RMA. Timing: Property included in the <br /> Services CFD prior to final map recordation. <br /> jjjj. Developer agrees to cooperate in the formation of, or annexation into, a community facilities <br /> district or districts (the "Facilities CFD") established pursuant to the Mello-Roos Community <br /> Facilities District Act of 1982 (Gov. Code §§ 53311-53368.3) (the"Mello-Roos Act") including <br /> approval of the Rate, Method of Apportionment and Manner of Collection of Special Tax ("RMA") <br /> for the purpose of financing the District's improvement of parks identified in the District's <br /> Community Facility Fee Program.
