Aboveground Petroleum Storage Act Program Inspection Report <br />Date: <br />August 21, 2025 <br />Facility Address: <br />5100 W HWY 12, LODIFRANK C ALEGRE TRUCKING INC <br />Facility Name: <br />Environmental Health DepartmentAMENDED <br />8/29/2025 <br />48 Code of Fed Regulations 112.8(c)(2) 4030010 - Adequately sized secondary containment provided and maintained for <br />bulk storage containers <br />OBSERVATION: The facility failed to provide and maintain secondary containment for bulk storage tank installations <br />sufficient to hold the capacity of the largest container, including adequate freeboard for precipitation. <br />- Many portable containers were found sitting inside of an orange colored plastic spill container which was used as <br />secondary containment, this plastic spill container was full of miscellaneous items that prevents the secondary <br />containment to sufficiently hold the capacity of the largest container. Additionally, one of the secondary containment spill <br />containers had a crack which prevents the tub from holding the capacity of the largest container. (IMG_1446, IMG_1447, <br />IMG_1450, IMG_1451) <br />REGULATION GUIDANCE: (c)(2)Construct all bulk storage tank installations (except mobile refuelers and other non- <br />transportation-related tank trucks) so that you provide a secondary means of containment for the entire capacity of the <br />largest single container and sufficient freeboard to contain precipitation. You must ensure that diked areas are sufficiently <br />impervious to contain discharged oil. Dikes, containment curbs, and pits are commonly employed for this purpose. You <br />may also use an alternative system consisting of a drainage trench enclosure that must be arranged so that any <br />discharge will terminate and be safely confined in a facility catchment basin or holding pond. <br />CORRECTIVE ACTION: Immediately provide and maintain adequate secondary containment for all the portable <br />containers with petroleum product. Submit proof of correction to the EHD. <br />This is a Repeat (Class 2) Violation. <br />54 Code of Fed Regulations 112.8(c)(6) 4010028 - SPCC discusses procedures to test/inspect storage containers for <br />integrity per industry standards <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss <br />procedures to test or inspect each aboveground container for integrity in accordance with industry standards and does <br />not address the following: 1. On a regular schedule. 2. After material repairs are made. 3. By qualified personnel. 4. The <br />frequency and type of testing and inspections based on container size, configuration, and design. <br />The SPCC plan does not address the procedures to test or inspect the following aboveground containers that were found <br />on site: <br />-> 330 gallon clear container of motor oil labeled "Delo 400 SDE SAE 15W-40" (IMG_1432) <br />-> 225 gallon clear tote labeled "Duron SHP 10W-30 Diesel Engine Oil" (IMG_1433) <br />-> 110 gallon silver tank of motor oil labeled "Mobil Delvac 1300 10W30" (IMG_1436) <br />-> approximately 85 gallon white tank of Chevron Delo 400 SAE 15W-40 (IMG_1442) <br />REGULATION GUIDANCE: (c)(6) Test or inspect each aboveground container for integrity on a regular schedule and <br />whenever you make material repairs. <br />CORRECTIVE ACTION: Ensure that the SPCC Plan adequately discusses facility's procedures to test and inspect <br />aboveground/bulk storage containers in accordance with all applicable industry standards. This discussion must include, <br />but not be limited to, inspection/testing schedule/frequency, and personnel qualifications. Submit proof of correction to <br />the EHD. <br />This is a (Class 2) Violation. <br />1868 E.
