collective) with the Site Lease and Facility Y acility Lease, the "Series 2012 G Bond Documents") the <br /> proceeds of which financed a portion of the costs of design and construction of the CHCF; and <br /> WHEREAS, pursuant to Government Code §14670, the DGS, with the consent of state agency <br /> concerned, may convey real property rights; and <br /> WHEREAS, pursuant to the Series 2012 A Bond Documents and the Series 2012 G Bond <br /> Documents, agreements such as this Agreement that affect the CHCF site require SPWB <br /> consent; and <br /> WHEREAS, Permittee owns and operates the Forward Landfill located near, and within the <br /> sphere of influence of the Facilities and Forward Landfill is regulated under Waste Discharge <br /> Requirements("WDRs") Order Nos. R5-2003-0049 for the application of treated groundwater and <br /> R5-2003-0080 for landfill operations; and <br /> WHEREAS, Permittee received Cleanup and Abatement Orders R5-2008-0714 and R5-2017- <br /> 0703 ("Orders") issued by the Central Valley Regional Water Quality Control Board <br /> ("CVRWQCB")which compels Forward Inc. and its agents, successors, and assigns to investigate <br /> the discharges of waste to groundwater, clean up the waste, and abate the effects of the waste <br /> resulting from the Forward Landfill; and <br /> WHEREAS, Permittee is attempting to comply with the Orders and has prepared site investigation <br /> work plans that include investigating and monitoring groundwater within lands adjacent to, in, and <br /> around the sphere of influence of the Forward Landfill, including the Facilities; and <br /> WHEREAS, Permittee is requesting a temporary right to access portions of the real property at <br /> which the Facilities are located for the purpose of implementing the following work plans: <br /> 1) The"Revised CDCR Site Investigation Work Plan"prepared by Arcadis U.S. Inc. on behalf <br /> of Permittee dated October 28, 2019 ("2019 Work Plan"), <br /> 2) The Work Plan for Drilling and Monitoring Well Installations (AMW-22) dated September <br /> 25, 2008 prepared by Herst&Associates, Inc. on behalf of Permittee <br /> 3) The Work Plan for Drilling and Monitoring Well Installations (AMW-22S and AMW 28) <br /> dated June 17, 2009, prepared by Herst&Associates, Inc. on behalf of Permittee. <br /> Together the 2019 Work Plan consisting of 33-pages, the 2008 Work Plan consisting of 20-pages <br /> and the 2009 Work Plant consisting of 19-pages constitute the "Work Plans". The Work Plans <br /> are attached hereto as EXHIBIT A and incorporated by reference herein; and <br /> WHEREAS, Permittee previously constructed monitoring wells at locations identified as AMW- <br /> 22, AMW-22S, and AMW-28 ("Existing Wells") in EXHIBIT B "Monitoring Well and Work Plan <br /> Premises", attached hereto and by reference made a part hereof, for the purpose of implementing <br /> the Work Plans; and <br /> WHEREAS, Permittee requires continued access to the Existing Wells for continued <br /> implementation of the Work Plans; and <br /> Right Of Entry Permit& Monitoring Well Agreement January 12, 2021 (L-2620) Page 2 <br />
