Responsible Permittee is solely responsible for all costs and expenses related to this Agreement, <br /> Party including the performance of the Work Plans and monitoring of any wells subject to this <br /> Agreement <br /> Right To Use State reserves the right to use Premises in any manner, provided such use does not <br /> unreasonably interfere with Permittee's rights herein. State reserves the right to prevent <br /> Permittee's entry to the Premises in the event of an emergency or public safety situation. <br /> Access Access to the Premises is granted to Permittee under the following terms. Permittee <br /> understands that the Premises are located within State Prison facilities and agrees that <br /> this Agreement is subject to any and all limitations and requirements customarily imposed <br /> as security measures of a State Prison facility. The State reserves the right to restrict or <br /> prevent entry upon, and access to, its property in the event of a suspected or actual <br /> emergency. Permittee understands that travel shall be restricted to such roads or routes <br /> within the Premises as the State's on-site representative may designate reasonable to <br /> carry out the Work Plans and rights within this Agreement. Use of roads or routes by <br /> Permittee shall be restricted to that use reasonably necessary in connection with the <br /> construction, operation, maintenance, repair, and monitoring of wells. <br /> Access Notice Thirty (30) days prior to commencement of the 2019 Work Plan, Permittee shall provide <br /> the State with a project schedule. Additionally, prior to entry upon the Premises Permittee <br /> shall give State at least seven (7) days written notice, which includes the following: <br /> i. The date of entry and commencement of Work, planned duration on the PREMISES, <br /> a final work schedule and a scheduled date of completion of Work on the Premises <br /> and date of demobilization. Permittee shall also provide State notice of any <br /> anticipated deviations from such schedule. <br /> ii. The name of the firm(s), license number, and person(s) performing the work. <br /> iii. A list of sample analyses anticipated for groundwater samples and other testing <br /> activities, including soils and air, is included in Exhibit A. <br /> iv. If equipment, analysis, or testing not identified in the project schedule is required, <br /> Permittee shall notify State in writing of this additional activity at least seven (7) days <br /> prior to commencement of the activity. <br /> Notwithstanding the access notice identified above, prior to entry upon Premises for any of <br /> the purposes herein, Permittee shall provide notice to State at least 24-hours in advance <br /> of access or reasonable notice if deemed an emergency, by written or oral notice to: <br /> Department of Corrections and Rehabilitation <br /> California Health Care Facility (CHCF) <br /> ATTENTION: Correctional Plant Manager <br /> 7707 Austin Road <br /> Stockton, CA 95215 <br /> Right Of Entry Permit & Monitoring Well Agreement January 12, 2021 (L-2620) Page 5 <br />
