immediately. prior to commencement of Permittee's activities pursuant to this Agreement as is practicable, including the removal of equipment and all other work necessary in accordance with all laws and regulations relating thereto. Laws Permittee shall comply with all local, State, and federal laws, policy, and regulations while exercising its rights herein. Record Keeping Permittee shall keep and maintain a record of all persons who enter the Premises pursuant to this Agreement. All persons who enter the Premises pursuant to this Agreement are required to sign a liability waiver in a form acceptable to the State prior to performing any work on the site. Copies of executed forms shall be made available to the State upon request. Should Permittee require a sample liability waiver one can be provided by State. Confidentiality To the extent possible and permitted by law, all activities Permittee undertakes at the Premises shall be considered confidential, especially with respect to facility layout, operations, and findings. Permittee will ensure that any and all public dissemination of data related to the Facilities will first be vetted by the State, with the concurrence of CDCR Office of Public Employee Communications (OPEC), including any interviews with news media. CHARACTERIZATION OF WORK: Drilling All drilling locations shall be checked for underground utilities by contacting Dig Alert at 8- 1-1 before conducting a surface geophysical survey, and by hand auguring each location to a depth of approximately five feet (5') or refusal. Authorizations Permittee shall have sole responsibility for obtaining all city, county, state, and federal authorizations necessary to perform the Work Plans. Notice of Upon completion of drilling and well construction activities, Permittee will provide Completion CDCR with a notice of completion indicating that the well construction is complete. Test Results Permittee shall provide State within 30 days, and at no cost to State copies of: (i) all analysis, reports, and studies generated as result of sampling and monitoring the soil, groundwater, and vapor as outlined in the 2019 Work Plan Phases 1- 3; and (ii) the results of each sampling event completed as part of the ongoing analysis and monitoring, including copies of any raw data and instrument printouts. Data will be provided in electronic portable document format ("PDF"), Microsoft Excel, Microsoft Word, or another format approved by State. Laboratory data will also be provided as laboratory reports in PDF format and electronic data deliverable in Microsoft Excel format, including but not limited to copies of the standard level II data package.
