6. INSTITUTIONAL CONTROLS <br /> Institutional controls will be implemented throughout the ARIC to provide for the protection of <br /> human health and the integrity of remedy components. Institutional controls would consist of a <br /> LUC that identifies the following restricted land uses and activities and associated monitoring <br /> and reporting requirements: <br /> 1. A residence, including any mobile home or factory-built housing, used as residential <br /> human habitation. <br /> 2. A hospital for humans. <br /> 3. A public or private school for persons under 18 years of age. <br /> 4. A day care center for children. <br /> 5. Any use of the Property in a manner that causes the covering or disturbing of <br /> groundwater monitoring wells, or any use of the Property in a manner that restricts <br /> access to groundwater monitoring wells. <br /> 6. There shall be no alteration of groundwater conditions within the Property, through <br /> activities such as construction of any well, extraction,use or consumption of <br /> groundwater from wells within the boundary of the Property,use of any groundwater <br /> within the boundary of the property, construction or creation of any groundwater <br /> recharge area, unlined surface impoundments or disposal trenches,unless specifically <br /> approved by the State. <br /> 7. Any use that would restrict investigation activities, remedial actions, or long-term <br /> maintenance and operations. <br /> 8. No activities that will disturb the soil (e.g., excavation, grading removal, trenching, <br /> filling, earth movement, or mining) shall be allowed on Property without a prior <br /> written plan approved by the State. <br /> 9. Any contaminated soils brought to the surface by grading, excavation, trenching, or <br /> backfilling shall be managed in accordance with all applicable provisions of state and <br /> federal law. <br /> 10. The Owner or Occupant shall provide the State written notice at least 14 days prior to <br /> any building, filling, grading, mining, or excavating in the Property. <br /> 11. The State shall have reasonable right of entry and access to the Property for <br /> inspection, monitoring, and other activities consistent with the purposes of the <br /> restrictions deemed necessary by the State to protect the public health or safety or the <br /> environment. The State shall, to the extent possible, provide advance notice to, and <br /> coordinate with the owner, lessee, or sublessee of the Property, as appropriate, <br /> regarding access requirements. <br /> 12. Monitoring and implementation of the restrictions will be conducted by the Owner. <br /> The Owner shall conduct an annual review of the Property and submit a letter report <br /> annually to both DTSC and the CVRWQCB summarizing compliance with all the <br /> Site 47 RAP for Soil 23 October 2023 <br />
