terms of the restrictions. If violations are noted, the annual report must detail the steps <br /> taken to return to compliance. If the Owner identifies any violations during the annual <br /> inspections or at any other time, the Owner must within ten(10) days of identifying <br /> the violation: determine the identity of the party in violation; send a letter advising the <br /> party of the violation; and demand that the violation cease immediately. Additionally, <br /> copies of any correspondence related to the enforcement of these restrictions shall be <br /> sent to DTSC and the CVRWQCB within ten(10) days of its original transmission. <br /> DTSC and the CVRWQCB shall have sole responsibility to enforce this requirement. <br /> 13. The Owner shall notify DTSC and the CVRWQCB of each of the following: (1) The <br /> type, cause, location and date of any disturbance to any remedial measures taken or <br /> remedial equipment or groundwater monitoring system installed on the Property that <br /> could affect the ability of such remedial measures, remedial equipment, or monitoring <br /> system to perform their respective functions; and(2) the type and date of repair of <br /> such disturbance. Notification to DTSC and the CVRWQCB shall be made by <br /> registered mail within ten(10)working days of both the discovery of such <br /> disturbance and the completion of repairs. <br /> The institutional controls would also include requirements for monitoring, inspections, and <br /> reporting to verify compliance with land use and activity restrictions. The reporting for these <br /> compliance inspections would be integrated with reports for the cover inspection and <br /> maintenance (Section 7). <br /> The LUC should be prepared consistent with DTSC policy and finalized and recorded after <br /> physical remedial measures are implemented and before the site is given a"Certification"by <br /> DTSC. The LUC will run with the land and stay in effect as long as hazardous substances limit <br /> use of the property and until terminated by DTSC. Pursuant to Section 67391.1 of CCR Title 22, <br /> Division 4.5, Chapter 39, the project proponent will pay all costs including for DTSC oversight <br /> associated with the administration of the land use controls. DTSC has authority to require <br /> modification or removal of any land improvements placed in violation of the restrictions. Also, <br /> violation of the LUC will be grounds for DTSC to file civil or criminal actions as provided by <br /> law. <br /> Also, the Pre-Decisional LUC will remain in full force and effect until revised and replaced by <br /> the State. <br /> The area requiring institutional controls is shown in Figure 11. <br /> Site 47 RAP for Soil 24 October 2023 <br />
